ACCESS EASEMENT
Eastlake ProfessionalCenter,LLC,GRANTOR(S),in considerationof $1.00 and for other and
valuableconsiderations,receiptof which ishereby acknowledged,grantsto The City of Bozeman,a
Municipal Corporationof the Stateof Montana,with officesat 121 North Rouse Avenue,Bozeman,
Montana 59715,GRANTEE,a publicaccesseasement fora pedestrianwalkway fortheuse of thepublic
in,through,and acrossa 10 feetwide stripof land situatedin GallatinCounty,Montana,which is
locatedon the followingdescribedproperty:
Lot lA of the platof Minor SubdivisionNo.221E,locatedin the southwest ¼of section
26,Township1 South,Range 5 East,PMM,in the City of Bozeman,GallatinCounty,
Montana
The easement ismore particularlydescribedon the attachedExhibit E which by this
referenceismade a parthereof.
The GRANTOR(S)agrees:
(1)To constructand maintain the pedestrianwalkway at theirown expense in accordance with
relevantCity Ordinances,including,but not limitedto,snow removal and allmajor and minor
repairwork.
(2)To allow the City to make any and all inspectionsof the pedestrianwalkway and land
appurtenanttheretoas the City reasonablydeems necessary.
(3)To reserve 10 feetof adjacentspace on both sidesof the access easement as right-of-way
setback.Permanent buildingstructuresand hardscape featuresshallnot be allowed within
setbacksunlessan encroachment permit has been obtainedfrom the city.
The GRANTOR(S)warrant that they are lawfully seized and possessed of the real
propertydescribedabove thatthey have a lawfulrightto convey the property,or any partof it,and that
they willforeverdefend the titleto thispropertyagainstthe claims of allpersons.
The GRANTOR(S)furtheragrees thatthe GRANTEE may peaceably hold and enjoy the rights
and privilegeshereingrantedwithout any interruptionby the GRANTORS.The terms,covenantsand
provisionsof thiseasement shallextend to and be binding upon the heirs,executors,administrators,
personalrepresentatives,successorsand assignsof the partieshereto.
