NOTICE OF A SITE PLAN APPLICATION & PUBLIC HEARING FOR
AN AGENCY EXEMPTION HEARING
Project Name: Bozeman Legion Baseball Indoor Facility SP Application: 21407
Summary: A site plan application was submitted proposing to add one 8,640sf building and limited
infrastructure improvements on the northeast most 5 acres of the Gallatin County Fairgrounds. The
building is to be used as indoor baseball practice area by the non-profit Bucks Organization. Two
ADA parking spaces and ADA accessible sidewalk will be added to the northeast corner of the
parking lot. The peak of the building is 30’, 4”.
An agency exemption is requested is proposed to allow the new building without the required
pedestrian facilities, curbing, striping, landscaping, grading requirements, building design, and
signage limitations required by the Bozeman Municipal Code. Fourteen Agency Exemptions are
proposed per Montana Code Annotated 76-2-402 to the following Sections of the Bozeman Municipal
Code:
BMC 38.220.100 Submittal Requirements for Landscape Plans;
BMC 38.410.080.H Stormwater retention/detention facilities;
BMC 38.520.040.C.1. Non-motorized circulation and design (Internal Circulation);
BMC 38.520.040.C.4 Pedestrian paths through parking lots;
BMC 38.520.040.C.5 Connection to adjacent properties;
BMC 38.520.040.D.2 Pathway design;
BMC 38.520.040.D.3 Pathways must be separated from structure by at least three feet of
landscaping;
38.520.040.E Bicycle Facilities;
BMC 38.520.070.D.1. Location and design of service and mechanical equipment (utility meters,
electrical conduit, and other service utility apparatus);
BMC 38.530.040.B Building massing and articulation (façade articulation);

Montana Code Annotated 76-2-402. Local zoning regulations -- application to agencies. Whenever an
agency proposes to use public land contrary to local zoning regulations, a public hearing must be held
and the agency shall attend the public hearing.
(2) The local governing body shall hold a hearing within 30 days of the date the agency gives notice to
the local governing body of its intent to develop land contrary to local zoning regulations.
The public may comment orally at the public hearing or in writing at or prior to the public hearing
regarding the agency exemption. Comments should identify the specific criteria of concern along with
facts in support of the comment. During the notice period the City will continue review for compliance
with applicable regulations.

Decision:
The City Commission will conduct a public hearing on the agency exemption on
Monday, August 9th, 2022 at 6:00 p.m. The meeting will be held in person in the City
Commission Room, City Hall, 121 N. Rouse Avenue Bozeman, MT, and streamed using
WebEx, an online video conferencing system.
