STRATEGIC PLAN:1.2 Community Engagement: Broaden and deepen engagement of the
community in city government, innovating methods for inviting input from
the community and stakeholders.
BACKGROUND:In accordance with Commission Resolution 5323 and the City of Bozeman's
Citizen Advisory Board Manual, all boards must have minutes taken and
approved. Prepared minutes will be provided for approval by the board at
the next regularly schedule meeting. Staff will make corrections identified to
the minutes before submitting to the City Clerk's Office.

Building Codes Residential and Commercial Provisions of the 2021 IECC Presentation
• Sustainability Program Manager Natalie Meyer presented on the 2021 IECC residential and
commercial building code provisions that are proposed for adoption by the state. The
Sustainability Advisory Board followed up with questions and a discussion.

RECOMMENDATION:Citizens Climate Lobby Presentation on Carbon Pricing.
STRATEGIC PLAN:6.3 Climate Action: Reduce community and municipal Greenhouse Gas
(GHG) emissions, increase the supply of clean and renewable energy; foster
related businesses.
BACKGROUND:Action 2.D.3 of the Bozeman Climate Plan recognizes that the
Intergovernmental Panel on Climate Change considers carbon pricing
"necessary" to reach carbon reduction goals. Thus, a carbon fee could be
used as an effective, market-based solution to reduce carbon and put
Bozeman on a path to carbon neutrality.
Kristen Walser of the Bozeman Chapter of Citizens Climate Lobby will
provide a brief presentation to the Sustainability Citizen Advisory Board on
strategies focused on non-partisanship and relationship building, including
important carbon pricing legislation under negotiation now in Congress.

SUBJECT:Model Homeowner's Association (HOA) Covenants Work Session.
MEETING DATE:June 8, 2022

RECOMMENDATION:Model Homeowner's Association (HOA) Covenants Work Session.
STRATEGIC PLAN:6.3 Climate Action: Reduce community and municipal Greenhouse Gas
(GHG) emissions, increase the supply of clean and renewable energy; foster
related businesses.
BACKGROUND:Resolution 5368 adopts Model HOA Covenants as a City Commission priority
for 2022-2023. Model HOA Covenants call for the establishment of model
Homeowner’s Association Covenants that encourage water conservation,
neighborhood and community connectivity, accessory dwelling units,
childcare, drought tolerant landscaping, composting, local food, recycling,
energy efficiency, and renewable energy.
A homeowner’s association (HOA) is an organization in a subdivision,
planned community, or condominium building that makes and enforces rules
for the properties and residents. Those who purchase property within an
HOA’s jurisdiction automatically become members. In some case, an HOA
can be more restrictive than the zoning and codes of the city or county
where the HOA is located. An HOA’s governing documents are usually in the
form of covenants, which set out the rules of the HOA community. They
describe the requirements and limitations of what a homeowner can do
with the property. The goal of the covenants are to protect, preserve, and
enhance property values in the community. Covenants may regulate things
such as of basketball hoops, clotheslines, fences, antennas, irrigation,
garbage cans, and rooftop solar.
Subdivisions are not required to have HOAs and covenants. The City of
Bozeman does not enforce covenants, and cannot require any provisions
within covenants. The development of model HOA covenants will provide
an opportunity for newly created HOA's to adopt language that is consistent
with the City's adopted plans.
Work Plan Item 2 in the Sustainability Citizen Advisory Board Work Plan
identifies that the Sustainability Citizen Advisory Board will initially offer

input on the potential barriers within existing HOA covenants, and will
subsequently review draft model covenants developed by City Staff, and
make a recommendation to the City Commission.
Natalie Meyer, City of Bozeman Sustainability Program Manager will provide
a brief presentation on the status of this effort to include an open discussion
with the Board. The Board will consider the following questions during
discussion:
Are you aware of common provisions within HOA covenants that may
be in conflict with the City of Bozeman's climate or resilience goals?
How might the City remedy these conflicts in model HOA covenants?
