HomeMy WebLinkAboutResolution 3220 MPA: Gateway - Urban Residential infill on 148.05 acres COMMISSION RESOLUTION NO. 3220 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE 1990 BOZEMAN AREA MASTER PLAN UPDATE BY ESTABLISHING AN INITIAL LAND USE ELEMENT OF "URBAN RESIDENTIAL INFILL" ON APPROXIMATELY 148.05 ACRES LOCATED IN THE SOUTHWEST ONE-QUARTER OF SECTION 2, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN. WHEREAS, the City of Bozeman and the Gallatin County Commission have adopted a master plan, pursuant to Section 76-1-604, M.C.A.; and WHEREAS, the proposed master plan amendment has been properly submitted, reviewed and advertised in accordance with the procedures set forth in Section 76-1-601 et seq., M.C.A., and the 1990 Bozeman Area Master Plan Update, dated October 1990; and WHEREAS, the City-County Planning Board held a public hearing on July 1, 1997, to receive and review all written and oral testimony on the request for the master plan amendment; and WHEREAS, the City-County Planning Boa rd recommended to the Bozeman City Commission and the Gallatin County Board of Commissioners that the requested master plan amendment to establish an initial land use element of "Urban Residential Infill" be approved; and WHEREAS, the City Commission adopted Commission Resolution No. 3194 on July 21, 1997, stating its intent to revise the 1990 Bozeman Area Master Plan Update to establish an initial land use element of "Urban Residential Infill" on the subject parcel; and WHEREAS, the City Commission opened its public hearing on July 21, 1997; and WHEREAS, the City Commission reopened and conducted its public hearing on August 11, 1997, to receive and review all written and oral testimony on the request for a master plan amendment; and WHEREAS, the City Commission has reviewed and considered the four criteria established in the 1990 Bozeman Area Master Plan Update, and found the proposed master plan amendment to be in compliance with the four criteria; and WHEREAS, the City Commission has found the proposed master plan amendment to establish an initial land use element of "Urban Residential Intill" on the subject parcel would be appropriate and constitute an overall improvement to the plan. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: That the 1990 Bozeman Area Master Plan Update is hereby amended by establishing an initial land use element of "Urban Residentiallnfill" on approximately 148.05 acres generally located -------.------ ./ between Durston Road and West Oak Street, west of the Smith Annexation, and more particularly described as follows: A 148.05-acre tract of land known as the Southwest one-Quarter of Section 2, Township 2 South, Range 5 East, excepting therefrom the West one.half of the West one-half of the Northwest one-Quarter of the Southwest one-Quarter and the West one.half of the West one-half of the Southwest one-quarter of the Southwest one.Quarter, Montana Principal Meridian, Gallatin County, Montana.
