Hi Madeline,
Thanks for following up, below is a preliminary CILWR determination for the Phase 1. Prior to finalized the
determination I’ll need to verify the irrigation source and demand. If possible we encourage the use of an exempt well to
supply the irrigation demand for projects as this reduces the CILWR for the applications and helps the City in our water
conservation goals. If your client is willing to go this route I need a preliminary determination from the DNRC that a
exempt well is allowed on the property and the well shown on the landscaping plans. If you reach out to the DNRC they
typically will just response with an email providing the determination.
As for the phased development of the project BMC 38.410.130 – Water Adequacy allows for compliance phase by phase
so payment for Phase 2 can be deferred until it’s site plan ready for approval. Just for reference with the information
provided I would apply the demand rate for the structure in Phase 2 (10,000gal/yr/1,000sf).

Hi Griffin,
I am working on a site plan application for a commercial project in Bozeman and was hoping to get a cash-in-lieu of
water rights determination. The project site is Lot 3A of Amended McChesney Industrial Park Subdivision and is located
at the southwest corner of the intersection of Nikles Drive and Evergreen Drive.
We’ve submitted a concept review application and have received comments back (application #21263). The proposed
improvements will be completed in two phases. I’m not sure if the phased development makes a difference in the cash-
in-lieu of water rights determination.
Attached is the subdivision plat and current site plan for the proposed development. Please let me know if there is any
other information I can send over.
