PUBLIC UTILITY EASEMENT
RIVERSIDE COUNTRY CLUB,INC.,a Montana non-profitcorporation,of 2500
SpringhillRoad,Bozeman MT 59718-8466,(the"GRANTOR"),inconsiderationof one dollar
and othergood and valuableconsideration,receiptof which ishereby acknowledged,does hereby
grantto CITY OF BOZEMAN,121 North Rouse Avenue,P.O.Box 1230,Bozeman,MT 59771,
a Municipal Corporationof the Stateof Montana,(the"GRANTEE"),itssuccessorsand assigns,
a perpetualeasement to lay,constructand maintain sewer mains with the usual services,
connections,accessoriesand appurtenances,includingbut limitedtopipesand liftstations,forthe
purpose of transmittingsewage in,through and acrossareasof landof variablewidth situatedin
GallatinCounty,Montana,to be locatedon thefollowingdescribedrealproperty(the"Easement
Property"):
Southwest one-quarterof thesoutheastone-quarterof Section23,Township 1 South,
Range 5 East,PrincipalMeridian Montana (P.M.M),GallatinCounty,Montana,which is
more particularlydescribedon ExhibitA attachedheretoand incorporatedhereinby
referenceand depictedinas theareacoloredinred.
This grantincludestherightof the GRANTEE,itssuccessors,permittees,licensees,and
assignsand itsand theiragentsand employees,toenteratalltimesupon theabove-described
Easement Propertyby using existingroadsor trailsorotherwiseby a routecausingthe least
damage and inconvenienceto theGRANTOR inordertosurveyand establishtherouteand
locationoftheeasement and thepipelineand to:
(1)Construct,operate,patrol,repair,substitute,remove,enlarge,replace,and maintainthe
pipeline,services,connections,accessoriesand appurtenances;
(2)Trim,remove,destroy,or otherwisecontrolany treesand brush insideoroutsidethe
boundariesoftheeasement which may,intheopinionof theGRANTEE,interfereor
threatento interferewith or be hazardous to theconstruction,operationand maintenance
of thepipeline;
(3)Grade thelandsubjectto thiseasement and extendthecutsand fillsof thisgrading into
and on the landadjacenttothatwhich issubjecttothiseasement totheextentGRANTEE
may findreasonablynecessary;and
(4)Support thepipelineacrossravinesand water courseswith structureswhich GRANTEE
deems necessary.
THE GRANTEE AGREES:
(1)That,inconnectionwith theconstruction,operating,patrolling,repairing,substituting,
removing,enlarging,replacing,and maintainingof saidpipelines,itwillrepairor replace,
atitssoleexpense,orpay toGRANTOR thereasonablevalueof any damages togrowing
crops,existingfences,ditchesand otherappurtenancesof saidlandthatmay be disturbed
by itsoperation.
(2)That,duringoperationsinvolvingexcavation,itwillremove thetopsoilfrom thetrenched
areatoa depth of one foot,or tothe fulldepth of thetopsoil,whichever isless,and
stockpilesaidtopsoilforreplacementover thetrench.Itwillremove from thesiteany
largerocksor surplusexcavatingmaterialor any debristhatmay have been exposed by
theexcavationand remains afterbackfillingiscompleted.And,itwillleavethefinished
surfaceinsubstantiallythe same conditionas existedpriortothebeginningof operations
exceptthatthe surfaceof backfilledareasmay be mounded sufficientlyto preventthe
formationof depressionsafterßnal settlementhas taken place.
THE GRANTOR AGREES:
(1)At no time willitbuild,construct,erector maintainany permanent structurewithinthe
boundariesof saideasement withoutthepriorwrittenconsentof GRANTEE.
(2)At no time willitmodify thefinishedgrade of the landover the pipelineby removal of
existingsoilor by placement of fillmaterialwithintheboundariesof saideasement
withoutthepriorwrittenconsentof theGRANTEE.

(3)That where thesubjectimprovements arenot locatedunder improved publicor private
streetsor otherprovidedaccess,a 12 footwide all-weatheraccessroad may be
constructedwithinthe Easement Propertywhere attheCity'sdiscretionsuch accessis
requiredforoperationand maintenance purposes.
(4)The GRANTOR warrantsthatitislawfullyseizedand possessedof therealproperty
describedabove as the Easement Property,thatithas a lawfulrighttoconvey the
property,or any partof it,and thatitwillforeverdefend thetitletothe Easement
Propertyagainsttheclaimsof allpersons.
(5)The GRANTEE may peaceably hold and enjoy therightsand privilegeshereingranted
withoutany interruptionby theGRANTOR.The terms,covenantsand provisionsofthis
easement and agreement shallextend toand be bindingupon the heirs,executors,
administrators,personalrepresentatives,successorsand assignsof thepartieshereto.
