HomeMy WebLinkAboutResolution 3230 Intent to create 1998 sidewalk program COMMISSION RESOLUTION NO. 3230 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, DECLARING THE CITY COMMISSION'S INTENT TO ESTABLISH A 1998 SIDEWALK PROGRAM AND TO ORDER THAT SIDEWALKS BE INSTALLED IN CERTAIN AREAS OF BOZEMAN, AS PROVIDED FOR IN SECTIONS 7-14A109 AND 7~14A110, MONTANA CODE ANNOTATED. WHEREAS, Section 7-14-4109, Montana Code Annotated, provides that a local governing body may order sidewalks constructed in front of any lot or parcel of land; and WHEREAS, on the 28th day of March 1994 the City Commission did adopt Commission Resolution No. 2965, revising the City's sidewalk pOlicy and adopting rating/ ranking sheets to serve as the basis for developing a priority listing for installation of sidewalks; and WHEREAS, the City staff has developed a priority list for sidewalk installation; and WHEREAS, the City Commission has determined that it is the best interests of the City of Bozeman to install sidewalks along the streets listed herein. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That, in accordance with the provisions of Section 7-14-4109, Montana Code Annotated, and the City's sidewalk policy, as established in Commission Resolution No. 2965, the City Commission declares its intent to order the installation of sidewalks along both sides of the following streets: 1 . South Black Avenue between East Lincoln Street and South Rouse Avenue; 2. Carol Place between Kagy Boulevard and South Black Avenue; 3. South Tracy Avenue between East Mason Street and Kagy Boulevard; 4. Mason Street between South Willson Avenue and South Rouse Avenue; 5. South Rouse Avenue between East Garfield Street and South Black Avenue; 6. Hoffman Drive between South Tracy Avenue and South Rouse Avenue; 7. Accola Street between South Black Avenue and South Rouse Avenue; 8. East Garfield Street a distance of one-half block east and west of South Rouse Avenue; and 9. East Lincoln Street a distance of one-half block east and west of South Rouse Avenue. Section 2 That at a regular session of the City Commission of the City of Bozeman, to be held in the Commission Room, Municipal Building, 411 East Main Street, Bozeman, Montana, on Monday, the 6th day of April 1998, at the hour of 7:00 p.m. of said day, is the time and place when and where the City Commission will hear testimony in support of and in opposition to the ordering of sidewalks as contained in Section 1, above. The Clerk of the City Commission is hereby directed to publish notice of the adoption of this resolution of intention. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 16th day of March 1998. ~~F'~Or/~ ATTEST: ~.~~ Clerk of the Commission APPROVED AS TO FORM: - 2 - NOTICE NOTICE IS HEREBY GIVEN that on the 16th day of March 1998, at a regular meeting of the City Commission of the City of Bozeman, Montana, said Commission duly and regularly passed and adopted Commission Resolution No. 3230, entitled: COMMISSION RESOLUTION NO. 3230 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING THE CITY COMMISSION'S INTENT TO ESTABLISH A 1998 SIDEWALK PROGRAM AND TO ORDER THAT SIDEWALKS BE INSTALLED IN CERTAIN AREAS OF BOZEMAN. AS PROVIDED FOR IN SECTIONS 7-14-4109 AND 7-14-4110, MONTANA CODE ANNOTATED. A copy of said Commission Resolution No. 3230 is on file in the office of the Clerk of the City Commission at 411 East Main Street, Bozeman, Montana, which states the City Commission's intent to install sidewalks along both sides of particular streets within the city limits of the City of Bozeman, as follows: 1. South Black Avenue between East Lincoln Street and South Rouse Avenue; 2. Carol Place between Kagy Boulevard and South Black Avenue; 3. South Tracy Avenue between East Mason Street and Kagy Boulevard; 4. Mason Street between South Willson Avenue and South Rouse Avenue; 5. South Rouse Avenue between East Garfield Street and South Black Avenue; 6. Hoffman Drive between South Tracy Avenue and South Rouse Avenue; 7. Accola Street between South Black Avenue and South Rouse Avenue; 8. East Garfield Street a distance of one-half block east and west of South Rouse Avenue; and 9. East uncoln Street a distance of one-half block east and west of South Rouse Avenue. NOTICE IS HEREBY FURTHER GIVEN that Monday, the 6th day of April 1998, at 7:00 p.m. at the Commission Room, Municipal Building, 411 East Main Street, Bozeman, Montana, is designated as the time and place set for hearing and passing on all public testimony in support of and in opposition to this proposed 1998 Sidewalk Program.
