The application is not currently under public comment as it is inadequate at this time and awaiting corrections from the applicant and their representative, however, your comment has been noted for our records and forwarded to the representative to address or respond to if they deem necessary. The zoning for the subject property is B-2 which allows for retail, and personal and convenience uses such as a gas station with automobile fuel sales as a special use within this zoning district. Based on the public comments received, major considerations to light pollution, noise, smell/odors, buffering, design, and landscaping will be taken into account with the applicant having to address the provisions specific to these issues from the Bozeman Municipal Code as well as additional conditions applied to the project that may be conditions of approval per Sec. 38.230.120. The neighboring and adjacent residences will be taken into account based on what can be utilized within the City’s Municipal Code to be applicable their Site Plan and Special Use Permit application. I would hope that youwould consider the integrity of this neighborhood (it is still a residential area) and not allow a gas station andconvenience store be built at that intersection. Trees The City was contacted the missing boulevard trees in the common space. There isno plan to plant these trees this spring. The possibility of future planting is doubtful. However, they said we can as an HOA do two things; 1) Submit as an HOA to get upto 5 trees planted if we pay 50% of the cost of the tree & planting. Or, 2) We cansubmit a plan to purchase & plant trees along the blvd with our own approved treeand vendor. The Board will be discussing this at their next Board meeting later this month. Dogs Please keep your dogs on their leashes.They are not to roam free and run upand down the trails. They are especially not allowed to harass the wildlife or otheranimals/pets in the area. Also, be agood neighbor and continue to pick upafter them. Trash Cans Trash cans need to be stored in your garage or behind an approved enclosure all days except pick up day. Campers, Recreational Vehicles, Etc Recreational season is approaching fast!Campers, trailers, boats, any type ofrecreational vehicles, are not allowed tobe stored in Crossing II on the streets or in your driveways except for loading andunloading purposes per your covenants.Your community appreciates your cooperation! Development There has been an initial plan application for a business to build at the NE corner of Baxter & Davis. This has yet to go to Public comment and the plan has been sentback to the business owner for alterations to the lighting plan and other details. Thisbusiness is a Thriftway Gas & Convenience store. We are keeping a close eye on thisand several residents have already emailed planning@bozeman.net with concerns to the city. More details and conversation are posted on the Crossing 2 Facebookgroup page. Opticom The latest information that the Board has heard was that Opticom had filed multiple motions to drop the suit and the judge has denied all of those. Baxter Meadowschose to change firms again due to a loose claim of conflict of interest by Opticomwhich has caused delay as the new team needed to get up to speed. They alsowere awaiting “discovery” documents from Opticom, which Opticom has beendelaying through multiple tactics. All discovery & disclosure has been delivered byBaxter Master.
