April 27, 2022 Dear Transportation Board, We would like to try to clarify further the confusion added to the code discussion by using the phrase 1 property=1 resident in the Appendix recommendations to be discussed at the meeting tonight. In the Municipal Code in Sec. 36.04.603 B4 it refers to the City initiating creation or changing a parking benefit zone. Residents may protest by submitting a written protest to the city clerk listing the resident’s physical address. If 60% or more of the total number of properties within the proposed Parking Benefit Zone object, then it won’t move forward and cannot be reintroduced for 6 months. In the Proposed Resolution 2022-03, Appendix A I b, it refers to property owners and renters within a proposed area creating or changing a parking benefit zone. This would be done by petition and if 60% of residences (1 property = 1 resident) within the proposed parking benefit zone sign to oppose, then the Transportation Board may not propose, modify, or dissolve all or a portion of the parking benefit zone for 6 months. Should both say 60% of the total number of properties or 60% of residences? What is a property and what is a residence? To make it clear to all involved, should the person bringing around the petition divide the petition up by a list of addresses? Would anyone living at the address have the opportunity to weigh in on a parking benefit zone in their area? Would the city take the petitions and determine what the vote is per address? How do you know if multiple addresses represent a property? Or should the property owner meet with all his/her renters in a property and get a consensus vote for the petition and sign off that the owner has met with renters? It is most likely that a volunteer resident of the proposed parking benefit zone will gather signatures in the case of initiating, modifying or dissolving the zone. Will that volunteer need to ask people if they own or rent? These questions and confusions need to be discussed to clarify the process to be used if either the city or residents initiate, modify or dissolve a parking benefit zone. Thank you for all the work you are doing on this Appendix and the actual Ordinance. It is very complicated, and we understand that you are trying to give every resident, whether they are an owner or a renter, a voice in this democratic process.
