ZERO LOT LINE AGREEMENT
Zero Lot Line Agreement (the “Instrument”) is made with respect to the real
property described in this Instrument owned by the following entities: Lot 7, 11, & 12 of
NWX.
The parties to this Instrument own the following real estate in the City of Bozeman,
Gallatin County, Montana:
NWX LLC is the owner of record of land located at West Oak St., in the City of
Bozeman, Gallatin County, Montana, and more particularly described as follows:
Lot 7 of Amended Plat of a Portion of S04, T02 S, R05 E, C.O.S. 2552,
PARCEL 5, ACRES 160.36, City of Bozeman, Gallatin County, Montana.
Northwest Crossing Subdivision – Phase 1 Plat [add Plat # when filed]
NWX LLC is the owner of record of land located at East Main St., in the City of
Bozeman, Gallatin County, Montana, and more particularly described as follows:
Lot 11 of Amended Plat of a Portion of S04, T02 S, R05 E, C.O.S. 2552,
PARCEL 5, ACRES 160.36, City of Bozeman, Gallatin County, Montana.

NWX LLC is the owner of record of land located at East Main St., in the City of
Bozeman, Gallatin County, Montana, and more particularly described as follows:
Lot 12 of Amended Plat of a Portion of S04, T02 S, R05 E, C.O.S. 2552,
PARCEL 5, ACRES 160.36, City of Bozeman, Gallatin County, Montana.

WHEREAS, Lots 7, 11, and 12 further desire to establish a zero-lot line agreement
for off-street parking amongst all of their respective properties, thereby not requiring lot
line setbacks that would otherwise be required under the Bozeman Municipal Code.
NOW, THEREFORE, for good and valuable consideration, the receipt of
sufficiency of which is hereby acknowledged, the parties hereto agree as follows:
1. ZERO LOT LINE AGREEMENT. Lots 7, 11, & 12 agree to allow zero lot line
development pursuant to § 18.38.060, BMC, amongst their respective properties, thereby
not requiring setbacks from lot lines for off-street parking otherwise required under the
Bozeman Municipal Code.

2. PERPETUAL AND APPURTENTANT. This easement and agreement, the
burdens and benefits created hereunder, shall be perpetual and shall run with the land,
and be binding upon and inure to the benefit of the parties hereto, their successors and
assigns.
3. COUNTERPARTS. This easement and agreement may be executed in any number
of counterparts with the same effect as if all parties hereto had all signed the same
document. All counterparts shall be construed together and shall constitute one
agreement.
