SEWER AND WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT
Human Resource Development Councilof DistrictIX,Inc.,theGRANTOR(S),in
considerationof $1.00 and othergood and valuableconsideration,receiptof which is
acknowledged,grant(s)to The Cityof Bozeman ,GRANTEE,itssuccessorsand assigns,a
perpetualcasement tolay,constructand maintain approx.343 LF PVC (sewer)and approx.
798 LF DIP (water)pipelineswith theusualservices,valves,connections,accessoriesand
appurtenancesforthepurposeof transmitting waterand sewer in,through,and acrossa strip
of landsituatedinGallatinCounty,Montana,minimum thirty(30)feetwide tobe located
on thefollowingdescribedrealproperty:Tract38 of theNortheastAnnexation toBozeman
The easement ismore particularlydescribedon theattachedExhibit A which by this
referencearemade a parthereof.
This grantincludestherightoftheGRANTEE,itssuccessors,permittees,licensees,and
assignsand itsand theiragentsand employees,toenteratalltimesupon theabove-described
landby usingexistingroadsor trailsorotherwiseby a routecausingtheleastdamage and
inconveniencetotheGRANTOR(S)inordertosurveyand establishtherouteand locationof the
easement and thepipelineand to:
(1)Construct,operate,patrol,repair,substitute,remove,enlarge,replace,and maintainthe
pipeline,services,connections,accessoriesand appurtenances;
(2)Trim,remove,destroy,orotherwisecontrolany treesand brush insideoroutsidethe
boundariesof theeasement which may,intheopinionoftheGRANTEE,interfereor
threatentointerferewith or be hazardoustotheconstruction,operationand maintenance
of thepipeline;
(3)Grade thelandsubjecttothiseasement and extendthecutsand fillsof thisgradinginto
and on thelandadjacenttothatwhich issubjecttothiseasement totheextentGRANTEE
may findreasonablynecessary;and
(4)Supportthepipelineacrossravinesand watercourseswithstructureswhich GRANTEE
deems necessary.
THE GRANTEE AGREES:
(1)That,inconnectionwith theconstruction,operating,patrolling,repairing,substituting,
removing,enlarging,replacing,and maintainingof said water and sewer pipeline(s),it
willrepairor replace,atitssoleexpense,orpay toGRANTOR(S)thereasonablevalueof
any damages togrowing crops,existingfences,ditchesand otherappurtenancesof said
landthatmay be disturbedby itsoperation.
(2)That,duringoperationsinvolvingexcavation,itwillremove thetopsoilfrom thetrenched
areatoa depthof one foot,ortothe fulldepthofthetopsoil,whichever isless,and
stockpilesaidtopsoilforreplacementover thetrench.Itwillremove from thesiteany
largerocksorsurplusexcavatingmaterialor any debristhatmay have been exposed by
theexcavationand remains afterbackfillingiscompleted.And,itwillleavethefinished
surfaceinsubstantiallythesame conditionasexistedpriortothebeginningofoperations
exceptthatthesurfaceof backfilledareasmay be mounded sufficientlytopreventthe
formationof depressionsafterfinalsettlementhas takenplace.
THE GRANTOR(S)AGREES:
(1)At no time willtheybuild,construct,erector maintainany permanent structurewithinthe
boundariesof saideasement withoutthepriorwrittenconsentof GRANTEE.
(2)At no time willtheymodify thefinishedgradeof thelandoverthepipelineby removal of
existingsoilorby placementof fillmaterialwithintheboundariesof saideasement
withoutthepriorwrittenconsentof theGRANTEE.
(3)That where thesubjectimprovements arenot locatedunder improved publicorprivate
streetsor otherprovidedaccess,a 12 footwide all-weatheraccessroadmay be
constructedwithinthecasement where attheCity'sdiscretionsuch accessisrequiredfor
operationand maintenance purposes.
(4)The GRANTOR(S)warrantsthattheyarelawfullyseizedand possessedofthereal
propertydescribedabove,thattheyhave a lawfulrightto convey theproperty,or any part
of it,and thattheywillforeverdefend thetitletothispropertyagainsttheclaimsofall
persons.
(5)The GRANTEE may peaceablyhold and enjoy therightsand privilegeshereingranted
withoutany interruptionby theGRANTOR(S).The terms,covenantsand provisionsof
thiseasement and agreement shallextendtoand be bindingupon theheirs,executors,
administrators,personalrepresentatives,successorsand assignsof thepartieshereto.
