HomeMy WebLinkAbout22- Release and Reconveyance of Easements - Stella Fria, LLC - Nelson MeadowsReturn to: City of Bozeman City Clerk PO Box 1230 .- art MT 59771-1230 RELEASE AND RECONVEYANCE OF EASEMENTS COMES NOW the City of Bozeman,121 N.Rouse Ave,MT59715,a Municipal Corporation of the State of Montana hereinafter ("GRANTOR")and does hereby release and reconvey the following described easements unto Stella Fria LLC,as follows: W I TN ESS ETH WHEREAS the Grantor is the legal record title holder of a 30'public utility and access easement situated across Lot 5A of Block 3 of Nelson Meadows Subdivision,City of Bozeman,Gallatin County,Montana. WHEREAS the above utilityeasements were granted by Nelson Meadows Final Plat by the following instruments: Final Plat of the Nelson Meadows Subdivision,of record in Book J of Plats,Page 680,recorded on October 19, 2020 at the Clerk and Recorder's Office of Gallatin County,Montana. WHEREAS no public utilitiesare located within the easements to be released and the vacation of the said easements will not adversely impact the Grantor's or the Public utilitycompanies interests. WHEREFORE,the Grantor does hereby release and reconvey to Stella Fria LLC,those portions of the utilitycasements located on the above described real property as set forth on the Exhibit attached hereto together with any right,title,or interest that the Grantor may have in said utilityeasements as set forth on the Exhibit attached hereto and incorporated herein by reference as though fully set forth and shown on the Exhibit. This reconveyance shall not affect the remainder of those easements shown on said Book of Plats J,page 680 in the Clerk and Recorder's office of Gallatin County,Montana. DATED this day of ,2p_22.
