Arthun - Riverside Country Club Easement 3 22 Zo22 0 Ce March 10,2022 Dear Mr.Mihelich and Mr. Maas: This letter pertains to the proposed Public Utility Easement that has been drafted and exchanged between the City of Bozeman ("City") and Riverside Country Club, Inc. ("RCC").As part of the ongoing annexation ef- forts,various agreements have been entered between the Riverside County Water and Sewer District No. 310 (the"District"),the City, and RCC. The primary intent of the annexation is to provide collection,treatment, and disposal of wastewater collected within the District. The proposed Wastewater Agreement between the District and City states that"any easements or rights of way necessary for the provision of wastewater services will be transferred to the City upon annexation."Providing such wastewater services will require among other things the construction of a lift station and the installation and extension of sanitary sewer lines on property owned by RCC. Subject to the City's approval of the annexation of the District,which includes but is not limited to RCC prop- erty, and the performance of each parties' obligations under the annexation and related agreements,RCC through its board of directors is pleased to confirm its willingness to grant the City an easement. The proposed easement contemplated by RCC will include all that is reasonably necessary for the City to construct,use, maintain,repair, and replace a wastewater lift station,wastewater lines, and infrastructure used by the City in the least restrictive manner on, across, over, and under RCC property. RCC's property and proposed easement is depicted on the attached Exhibit A, and RCC's offer to grant the City this easement is without additional consideration from the City to RCC. Please review Exhibit A and let us know if the proposed boundaries of the easement are acceptable to the City. Given RCC's proximity and experience as part of the District,RCC believes that the boundaries proposed in Exhibit A should provide the City sufficient access for the proposed wastewater transport and treatment.
