WHEREAS, the City of Bozeman has granted the Transportation Advisory Board oversight and advisory capacity over transportation issues in the City of BozemanthroughResolution 5326; and, WHEREAS, the City of Bozeman Strategic Plan includes goals 4.1 Informed Conversation on Growth, 4.2 High Quality Urban Approach, 4.4 Vibrant Downtown, Districts, and Centers, and 4.5 Housing and Transportation Options and, WHEREAS, the City of Bozeman 2016 Downtown Strategic Parking Management Plan guides strategic decisions relating to the City’s parking system and, WHEREAS, the City of Bozeman 2017 Master Transportation Plan guides strategic decisions for the City on all things related to Transportation and, WHEREAS, the 2020 Sustainability Plan and 2021 Community Plan both provide guidance to City staff and Advisory Boards on how to manage the City’s transportation infrastructure and network and plan for the future in Bozeman, and, NOW THEREFORE, BE IT RESOLVED that the Transportation Advisory Board adopts the 2022-2023 Work Plan as outlined in Attachment A to guide all actions taken by the Transportation Advisory Board for the next two years; Passed and adopted by the Transportation Advisory Board of the City of Bozeman, Montana, at a session held on the 22nd day of February 2022. ______________________________________ Kelly Pohl, Chair Transportation Advisory Board 6 Resolution 2022-02 Transportation Advisory Board Work Plan 2022-2023 Page 2 of 2 ATTEST: ___________________________ Jeff Mihelich, City Manager City of Bozeman 7 Memorandum REPORT TO:Transportation Board FROM:Veselik SUBJECT:Acting as the Parking Commission, adoption of Resolution 2022-03 Establishing Rules for the Creation, Modification, and Dissolution of the Parking Benefit Zones MEETING DATE:March 23, 2022 AGENDA ITEM TYPE:Resolution RECOMMENDATION:I move to approve Resolution 2022-03 Establishing Rules for the Creation, Modification, and Dissolution of the Parking Benefit Zones STRATEGIC PLAN:4.2 High Quality Urban Approach: Continue to support high-quality planning, ranging from building design to neighborhood layouts, while pursuing urban approaches to issues such as multimodal transportation, infill, density, connected trails and parks, and walkable neighborhoods. BACKGROUND:In August 2020, the City Commission approved Ordinance 2033 on second reading. The Ordinance allowed for the creation of Parking Benefit Zones to protect residents near the downtown core from spillover parkers who are trying to avoid downtown parking regulations. The Parking Commission had intended to adopt these rules for establishing the districts in Fall 2020, but due to staff turnover and competing priorities, they were never adopted. Staff is bringing the Resolution to this board to ensure a procedure is in place ahead of any final decision on paid parking by the City Commission. Page 1 of 4 TRANSPORTATION ADVISORY BOARD RESOLUTION 2022-03 A RESOLUTION OF THE TRANSPORTATION ADVISORY BOARD ACTING AS THE PARKING COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO ADOPT THE RULES OF PROCEDURE FOR CREATING A PARKING BENEFIT ZONE IN THE CITY OF BOZEMAN. WHEREAS, the City of Bozeman has granted the Transportation Advisory Board acting as the Parking Commission authority to regulate all on- and off-street parking in the B-3 zoning district through Resolution 5326; and, WHEREAS,In order to actively manage public parking resources in areas where on-street parking may be impacted by large, nearby, attractions such as downtown, commercial, education, health care, or other facilities, the Bozeman Transportation Advisory Board recognizes the creation of Parking Benefit Zones, in the Downtown Parking District, as an important management tool; and, WHEREAS, the desired outcomes of a Parking Benefit Zone are the facilitation of visitor parking turnover, reduced need for off-street parking lots, the encouraged use of private shared parking agreements, and maximized on-street parking opportunities; NOW THEREFORE, BE IT RESOLVED that the Transportation Advisory Board Acting as the Parking Commission establishes the rules for the creation, modification, and dissolution of Parking Benefit Zones in the Downtown Parking District as written in Appendix A; Passed and adopted by the Transportation Advisory Board of the City of Bozeman, Montana, at a session held on the 23rd day of March 2022. ______________________________________ Kelly Pohl, Chair Transportation Advisory Board ATTEST: 9 Resolution 2022-03 A RESOLUTION TO ADOPT THE RULES OF PROCEDURE FOR CREATING A PARKING BENEFIT ZONE IN THE CITY OF BOZEMAN. Page 3 of 4 APPENDIX A I.Creation, Modification, Dissolution of Parking Benefit Zones in the Downtown Parking District a. As specified in the Sec. 36.04.604 of the Bozeman Municipal Code, the Bozeman Parking Commission may initiate the process for creation, modification, or dissolution, of all, or a portion, of a parking benefit zone in the Downtown Parking District with, or without, citizen request. b. A petition signed by 60% of property owners within a proposed parking benefit zone in the Downtown Parking District can initiate a process to create, modify, or dissolve, all, or a portion, of a parking benefit zone 1 If 60% of residents protest the creation of a Parking Benefit Zone, the Transportation Advisory Board acting as the Parking Commission may not propose, modify, or dissolve all, or a portion, of a parking benefit zone c.The Bozeman Parking Commission will adopt a resolution of intent for the purpose of initiating a process to create, modify, or dissolve, all, or a portion, of a parking benefit zone in the Downtown Parking District. Upon approval of the resolution of intent, the Parking Services Division will collect, and forward to the Bozeman Parking Commission zone- specific parking occupancy data, to include: 1 Does on-street parking occupancy within the proposed, or existing, parking benefit zone demonstrate 85% occupancy for a contiguous three hour period, on at least three different weekdays? Note:the 85% occupancy is not intended as a strict criteria for creation of a Parking Benefit Zone. d. Upon adoption of the resolution of intent, and at least fifteen (15) days prior to a public hearring, by the Bozeman Transportation Advisory Board acting as the Parking Commission, regarding the creation, modification, or dissolution of a of a parking benefit zone, the Parking Services Division will notify all property owners, within the affected area, by postal mail, as well as placing an advertisement in a newspaper of record, utilizing appropriate social and traditional media outlets, and physical signage. e.With consideration of data collected by the Parking Services Division, as required by this section, the Bozeman Parking Commission, will hold a public hearing on the creation, modification, or dissolution of all, or a portion, of a parking benefit zone in the Downtown Parking District. f.At the conclusion of the public hearing, the parking commission may establish, amend, or dissolve a parking benefit zone by adopting a resolution. The resolution is not effective for 30 (thirty) days after adoption; as such, the parking commission may not regulate parking within a newly established or amended parking benefit zone until 30 (thirty) days after adoption of the resolution establishing or altering the parking benefit zone. A resolution to dissolve a parking benefit zone is effective immediately upon adoption. g. A resolution of the Bozeman Parking Commission designating an area of the Downtown Parking District as a parking benefit zone shall describe: 1. The designated public street area along which parking will be limited to vehicles registered to or controlled and exclusively used by persons residing in the area; 2. Page 4 of 4 3. The individuals eligible to purchase a permit; 4. Effective dates of annual permits; 5. Visitor permit, transient permit, and paid time limited parking provisions for the parking benefit zone. h. Upon adoption of a resolution by the Bozeman Parking Commission designating an area for parking benefit zone parking only, signs shall be erected along the streets identified in the ordinance prior to any enforcement of the parking benefit zone regulations pursuant to section 36.04.090. BACKGROUND:The Administrative Review Board has responsibility hear appeals from citizen's who are appealing the Parking Manager's decision on their first appeal of a citation. The hearings are held on an as-needed basis and are governed by Section 36.04.3803.G of the Bozeman Municipal Code.
