TEMPORARY STORM WATER FACILITY EASEMENT
CITY OF BOZEMAN,GALLATIN COUNTY,MONTANA
Bon Ton Inc.,GRANTOR,inconsiderationof the receiptof One Dollar($1.00)and forother
valuableconsideration,receiptof which ishereby acknowledged,does hereby grantto theCity
of Bozeman,a municipal corporationof the Stateof Montana,with officesat 121 North Rouse
Avenue,P.O.Box 1230,Bozeman,Montana 59771-1230,GRANTEE,a temporary Storm
Water FacilityEasement forthe use of storm water run-offand retentionuntilsuch time when
publicstreetsareconstructedand storm sewer installedand connected to the storm water
collectionsystem which drainsto the temporary basins.The temporary Storm Water Facility
Easements are on a parcelof land situatedin theCity of Bozeman,and locatedon the following
describedrealproperties:
Lot 2 Block 2 Allison SubdivisionPhase 4A
The easements aremore particularlydescribedon theattachedExhibitsAl &A2 which by this
referenceismade a parthereof.
The GRANTOR statesthathe possessestherealpropertydescribedabove and thathe has
a lawful rightto grantan easement thereon.
The GRANTOR furtheragrees thatthe GRANTEE may peacefullyhold and enjoy the
rightsand privilegeshereingrantedwithoutany interruptionby theGRANTOR.
The terms,covenants and provisionsof thiseasement and agreement shallextend to and
be binding upon theheirs,executors,administrators,personalrepresentatives,successorsand
assignsof the partieshereto.
