Landowner agreestheCityhasthesolerighttocontrolthedesignandconstructionofsuchimprovements and may includeany oftheabovecomponentsand othersnecessarytoensuresuchimprovementscomplywithall adoptedCityinfrastructureplansandrequirements.Further,theLandownerwaivesitsrightortomake anywritten protestagainstthesizeorareaor creationofthedistrictbe assessedinresponsetoa dulypassedresolutionof intentiontocreateone ormore specialimprovementdistrictswhich would includetheabove-describedproperty. Intheeventa specialdistrictorspecialimprovementdistrictisnotutilizedforthecompletionofthese improvements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthecompletionof said improvementson a fairshare,proportionatebasisasdeterminedby theCityon thebasisofthe squarefootageof property,taxablevaluationoftheproperty,trafficcontributionfromthedevelopmentora combinationthereof. Thiswaiverismade forthebenefitofthepropertydescribedhereinshallbe a covenantrunningwiththe land.
