The undersignedowner oftherealpropertysituatedintheCountyofGallatin,StateofMontana,andmore
particularlydescribedasfollows:

IN CONSIDERATION ofreceivingSitePlanapprovalofthesubjectpropertyfromtheCityofBozeman,
alongwithaccompanyingrightsand privilegesand forotherand valuableconsideration,thereceiptofwhich is
herebyacknowledged,and inrecognitionoftheimpactsto

nelization,paving,curb/gutter,sidewalk,and stormdrainage.

districtsor specialimprovement districtsforthe designand engineering,constructionand maintenanceof
followingstreetimprovements:includingpaving,curb/gutter,sidewalk,and stormdrainage,and intersections.
Landowner agreestheCityhasthesolerighttocontrolthedesignandconstructionofsuchimprovements
and may includeany oftheabovecomponentsand othersnecessarytoensuresuchimprovementscomplywithall
adoptedCityinfrastructureplansandrequirements.Further,theLandownerwaivesitsrightortomake anywritten
protestagainstthesizeorareaor creationofthedistrictbe assessedinresponsetoa dulypassedresolutionof
intentiontocreateone ormore specialimprovementdistrictswhich would includetheabove-describedproperty.
Intheeventa specialdistrictorspecialimprovementdistrictisnotutilizedforthecompletionofthese
improvements,thedeveloperagreestoparticipateinan alternatefinancingmethod forthecompletionof said
improvementson a fairshare,proportionatebasisasdeterminedby theCityon thebasisofthe squarefootageof
property,taxablevaluationoftheproperty,trafficcontributionfromthedevelopmentora combinationthereof.
Thiswaiverismade forthebenefitofthepropertydescribedhereinshallbe a covenantrunningwiththe
land.
The terms,covenantsand provisionsofthiswaivershallextendto,and be bindingupon thesuccessors-
in-interestandassignsoftheLandowner.
