5 East,P.M.M.,Cityof Bozeman,GallatinCounty,Montana,accordingtotheofficialplatthereofon
fileand of recordintheofficeof theCounty Clerkand Recorderof GallatinCounty,Montana
IN CONSIDERATION of receivingapprovalfor Development Entitlementsof the subject
propertyfrom the Cityof Bozeman,along with accompanying rightsand privilegesand forotherand
valuableconsideration,thereceiptof which isherebyacknowledged,and inrecognitionoftheimpacts
to publicinfrastructurewhich willbe causedby thedevelopmentof theabove-describedproperty,the
owner has waived and does herebywaive foritself,itssuccessorsand assignsforevertherighttoprotest
the creationof one or more specialdistrictsor specialimprovement districtsfor the design and
engineering,constructionand maintenanceof followingimprovements:
a.Streetimprovements toW.GarfieldStreetincludingpaving,curb/gutter,sidewalk,and stormdrainage
b.Streetimprovements toS.27thStreetincludingpaving,curb/gutter,sidewalk,and storm drainage
c.Streetimprovements toFowler Avenue includingpaving,curb/gutter,sidewalk,and storm drainage
d.IntersectionimprovementstoFowlerAvenue and W.GarfieldStreet
e.IntersectionimprovementstoFowlerAvenue and HuffineLane
f.IntersectionimprovementstoS.27thStreetand W.GarfieldStreet
g.IntersectionimprovementstoW.GarfieldStreetand S.19thAvenue
h.IntersectionimprovementstoW.CoIIegeStreetand S.19thAvenue
i.IntersectionimprovementstoW.CollegeStreetand HuffineLane
Landowner agreesthe City has the solerightto controlthe designand constructionof such
improvements and may includeany of the above components and othersnecessaryto ensuresuch
improvements comply with alladopted City infrastructureplans and requirements.Further,the
Landowner waives itsrightor to make any writtenprotestagainstthe sizeor area or creationof the
districtbe assessedin responseto a duly passed resolutionof intentiontocreateone or more special
improvement districtswhich would includetheabove-describedproperty.
Intheeventa specialdistrictor specialimprovement districtisnotutilizedforthecompletionof
these improvements,the developeragrees to participatein an alternatefinancingmethod for the
completionof saidimprovements on a fairshare,proportionatebasisas determinedby theCityon the
basisof the squarefootageof property,taxablevaluationofthe property,trafficcontributionfrom the
development ora combinationthereof.
This waiver ismade forthebenefitof thepropertydescribedhereinshallbe a covenantrunning
with theland.
The terms,covenantsand provisionsof thiswaiver shallextend to,and be bindingupon the
successors-in-interestand assignsoftheLandowner.
