IN CONSIDERATION of receivingapproval forSitePlan of the subjectproperty from the City of Bozeman,along with accompanying rightsand privilegesand for other and valuable consideration,the receiptof which ishereby acknowledged,and in recognitionof the impacts to City transportation and infrastructure systems which will be caused by the development of the above-described property,the owner has waived and does hereby waive for itself,itssuccessorsand assigns foreverthe rightto protestthe creationof one or more special districtsor specialimprovement districtsfor the design and engineering,constructionand maintenance of followingimprovements: 1.Streetimprovements toN.27th Avenue between CattailSt and E Valley Center Rd includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. 2.Streetimprovements toCatamount St between Davis Lane and E Valley Center Rd includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. 3.Streetimprovements to CattailSt between Davis Lane and N 19*Ave includinglighting, signalization,paving,curb/gutter,sidewalk,and storm drainage. 4.Streetimprovements to N 19thAve between CattailSt and Frontage Road including lighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. 5.Streetimprovements to E Valley Center Rd between N 27*Ave and N 19*Ave includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage 6.Streetimprovements to Davis Ln between CattailSt and Catamount St including lighting,signalization,paving,curb/gutter,sidewalk,and storm drainage 7.Intersectionimprovements atCatamount St and N 27thAve includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. 8.Intersectionimprovements atCatamount St and E Valley Center Rd includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. 9.Intersectionimprovements atE Valley Center Rd and N 19thAve includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. 10.Intersectionimprovements atCattailSt and N 27*Ave includinglighting, signalization/channeli7.ation,paving,curb/gutter,sidewalk,and storm drainage. Landowner agrees theCity has thesolerighttocontrolthedesignand construction of such improvements and may includeany of the above components and othersnecessary to ensure such improvements comply with alladopted City infrastructureplans and requirements. Further,the Landowner waives itsrightor to make any writtenprotestagainstthesizeor areaor creationof the districtbe assessedinresponsetoa duly passed resolutionof intentiontocreateone or more specialimprovement districtswhich would includethe above-describedproperty. In the event a specialdistrictor special improvement districtis not utilizedfor the completion of these improvements,the developer agrees to participatein an attemate Gnancing method forthecompletion of saidimprovements on a fairshare,proportionatebasisas determined by theCity on thebasisof thesquare footageof property,taxablevaluationof theproperty,trafßc contributionfrom the development or a combination thereof. This waiver ismade for the benefitof the propertydescribedhereinshallbe a covenant running with the land.
