Dear Mayor Andrus, Deputy Mayor Cunningham, City Commissioners and Mr. Mihelich,
I am writing to request that the Canyon Gate Declaration of Covenants, Conditions and
Restrictions (CCR) be modified to restrict the height limitation of structures in thedevelopment to 50 feet and that the process for amending the CCR include at least a 30 day
notice to the public.
It appears that certain city staff have inserted an option to allow for 4 stories which couldresult in structures greater than the 50 foot limitation indicated by Commissioner Madgic
during the meeting. Based on review of the video from the meeting, this was not the languageused by Commissioner Madgic in her amendment. Rather, this is what was requested by
Andrew Holloran. Is the city staff working for the City of Bozeman or Mr. Holloran? Basedon the modification to the amendment, the structures could be substantially taller than 50 feet.
I hope you will agree that the height limitation of 50 feet should be clarified in the CCR.
The process of amending the CCR does not include any provisions for input from thecommunity surrounding Canyon Gate. Neither my neighbors on Valhalla Court nor I had any
notification that Canyon Gate was being considered for development until we were notified bythe Deny Canyon Gate group and we live adjacent to the proposed development. Mr.
Holloran’s efforts in contacting the local community were thoroughly inadequate. Hiscompromises were only offered after intense community resistance to his project. Based on the
wording of the Amendment section of the CCR, Mr. Holloran could easily revise theagreement without consideration of the impact on the community. I implore you to revise this
section of the CCRs to include a 30 day public notification.
I appreciate the extensive time that the Mayor, Deputy Mayor and City Commissioners haveinvested in considering the public concerns about this project. Your oversight is essential to
ensuring the safety and continued quality of life in Bozeman.
