Dear Mr. Mihelich, Mayor Andrus, City Commissioners, and Mr.
Sullivan,
I am writing to protest the language which was approved in the Consent
Item F.4 Final Adoption of the Canyon Gate Annexation Agreement.
The wording does not conform to what the Commissioners approved
when voting on January 11, 2022. It was clarified several times during
the Jan 11th meeting that the maximum height would be limited to 50ft
throughout the development, not 50ft or 4 stories, whichever is greater.
While it might seem like a minor change, this “update” allows for a much
different development than the city commission approved.
The vote on Jan. 11th was legally binding and the subsequent
documentation needs to reflect that vote.
I respectfully request that the city commission correct this immediately.

Please see below for evidence in support of this protest:
The applicant’s proposed Annexation Agreement submitted Dec. 21,
2021 proposed a height limit of “50 feet or 4 stories, which is greater”
within the R-5 zoning district. In considering the proposal at the Jan. 11,
2022 meeting, Commissioner Madgic made an amendment to limit the
maximum height at 50 ft throughout the entire project. Initially she stated
50 ft or 4 stories (2h10min) but this is later clarified by both her and
Mayor Andrus to be a limited height of 50 ft throughout the entire project
(see 2h10min-2h13min). This was clarified yet again by Mayor Andrus
at 2h17min where she again states the entire project to be limited to
50 ft. The amendment then passed at 2h18min. There is no question
that 50 feet is the maximum height intended by this amendment, and
that it is to limit the height within the R5, B2M, REMU and R3 districts
on the parcel.
