HomeMy WebLinkAbout005 Appendix D - Release of easement1 RELEASE AND RECONVEYANCE OF EASEMENT(S) COMES NOW the City of Bozeman, 121 North Rouse Avenue, Bozeman, MT 59715, a Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and reconvey the following described easement(s) unto Eastlake Professional Center, LLC, hereinafter (“GRANTEE”) as follows: W I T N E S S E T H WHEREAS the Grantor is the legal record title holder of the Public Road Easement (Document No. 2008890) situated across a tract of land, said tract being Lot 1A of the plat of Minor Subdivision No. 221E, located in the southwest ¼ of section 26, Township1 South, Range 5 East, PMM, in the City of Bozeman, Gallatin County, Montana, copies of which are attached hereto and are shown on the attached Exhibit “A”, which by this reference are made a part hereof; WHEREAS the above Public Road Easement was granted March 8th, 2000 and recorded on March 14th, 2000 at the Clerk and Recorder's Office of Gallatin County, Montana, on page 1 of document 2008890. WHEREAS the construction of the Public Road has not been completed, and will not occupy said easements recorded on March 8th 2000, and WHEREAS new utility, and access easements and agreements with the City of Bozeman, as shown on Exhibit F, for locations of utilities, public infrastructure, and access routes will be filed in the Gallatin County Clerk and Recorder’s Office. WHEREFORE, the Grantor does hereby release and reconvey to Eastlake Professional Center, LLC those portions of the easement(s) located on the above-described real property as set forth on Exhibit A attached hereto together with any right, title, or interest that the Grantor may have in said easements as set forth on Exhibit A attached hereto and incorporated herein by reference as though fully set forth. 2 DATED this ______ day of _____________________, 20 . ____________________________________ GRANTOR - CITY OF BOZEMAN Title _____________________________ ATTEST: City Clerk STATE OF MONTANA ) ) ss.
