COMMISSION RESOLUTION NO. 3245
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ESTABLISHING THE "1998B SIDEWALK PROGRAM" AND
ORDERING THAT SIDEWALKS BE INSTALLED IN CERTAIN AREAS OF
BOZEMAN, AS PROVIDED FOR IN SECTIONS 7-14-4109 AND 7-14-4110,
MONTANA CODE ANNOTATED.
WHEREAS, Section 7-14-4109, Montana Code Annotated, provides that a local
governing body may order sidewalks constructed in front of any lot or parcel of land; and
WHEREAS, the City Commission has established a program for installation of
sidewalks along streets throughout the entire community; and
WHEREAS, the City Commission did, on the 18th day of May 1998 adopt
Commission Resolution No. 3238, stating its intent to order in sidewalks along specified
streets within the city of Bozeman; and
WHEREAS, the City Commission did, after due and legal notice, on the 1 st day of
June 1998 conduct a public hearing on its intent to order in sidewalks; and
WHEREAS, after its public hearing, the City Commission did, on the 1 st day of June
1998 determine that the installation of sidewalks along the below-listed streets is of high
priority and is necessary for the pedestrians of the City of Bozeman.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:
Section 1
That sidewalks are hereby ordered to be installed on both sides of the street, under
the provisions of Section 7-14-4109, Montana Code Annotated, and in accordance with the
City's sidewalk policy, as established in Commission Resolution No. 2965, as follows:
1. Ravalli Street from Fowler Avenue to the west line of Valley Creek
Subdivision, Phase 1;
2. Golden Valley Drive from Prairie Avenue to Ravalli Street;
3. Prairie Avenue from Ravalli Street to the south line of Valley Creek
Subdivision, Phase 1;
4. Powder River Avenue from Ravalli Street to Golden Valley Drive;
5. Treasure Avenue from Ravalli Street to Golden Valley Drive;
6. Stillwater Avenue from Ravalli Street to Golden Valley Drive;
7. North 24th Avenue from West Babcock Street to West Beall
Street;
8. West Mendenhall Street from North 24th Avenue to the west line
of West Babcock Subdivision;
9. Hunters Way from West Babcock Street to the north line of
Westgate Subdivision;
10. West Mendenhall Street from
the east line of
Westgate
Subdivision to the west line of Westgate Subdivision;
11. Gena Circle from Hunters Way to its easterly terminus;
12. Sweetgrass Avenue from Beaverhead Street to its southerly
terminus;
13. Beaverhead Street from Sweetgrass Avenue to the east line of
Cascade Subdivision, Phase 1;
14. Cascade Street from Fowler Avenue to the east line of Cascade
Subdivision, Phase 1;
15. Broadwater Street from Sweetgrass Avenue to the east line of
Cascade Subdivision, Phase 1;
16. Boylan Road from its northerly intersection with Story Mill Road
to its southerly intersection with Story Mill Road;
17. Birdie Drive from Boylan Road to Bridger Drive;
18. Par Court from Boylan Road to its southerly terminus;
19. North 25th Avenue from West Babcock Street to the north line of
Brookside Subdivision;
20. Virginia Way from West Babcock Street to Donna Avenue;
21. Marilyn Court from Virginia Way to its easterly terminus;
22. Donna Avenue from the
east line of Babcock Meadows
Subdivision, Phase 1, to the west line of Babcock Meadows
Subdivision, Phase 1;
23. Hunters Way from Durston Road to the south line of Greenway
Subdivision;
24. Dove Court from Hunters Way to its easterly terminus;
25. Grouse Court from Hunters Way to its easterly terminus;
26. West Villard Street from the east line of Greenway Subdivision to
the west line of Greenway Subdivision;
27. Greenway Avenue from Durston Road to West Villard Street;
28. Greenway Court from West Villard Street to its terminus; and
29. Durston Road (south side only) from the east line of Greenway
Subdivision to the west line of Greenway Subdivision.

Section 2
That, pursuant to Section 7-14A109(3), written notice shall be mailed to every
owner or agent of the owner, and to any purchaser under contract for deed of such property,
notifying them that they are required to construct a City-standard sidewalk in front of their
lot or parcel of land and, if they fail or neglect to install said sidewalk by October 15, 1998,
or within thirty (30) days of the date of the written notice, whichever is the latter, the City
may construct or cause to be constructed the sidewalk and will assess them the cost
thereof, including engineering costs and costs enumerated in Sections 7-12-4121 and
7-12-4169, Montana Code Annotated, against the property in front of which the sidewalk
was constructed.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana,
at a regular session thereof held on the 15th day of June 1998.
