I apologize for the misinformation before as I’ve been receiving more guidance on this provision which impacts your project and I wanted to make sure you had the right information. The roof top mechanical equipment screening is applied as 100% screening horizontally (from the side). The units must be screen at least to the top of the mechanical equipment to provide any side views. The treatments from views down on top of the mechanical equipment would only be necessary for existing buildings and uses that may be impacted by the mechanical equipment. As long as the mechanical equipment is screened from the sides and is clearly shown on the elevations, this is acceptable. You do not need to provide further viewpoints for any potential buildings that may be developed. Thank you and sorry for the misinformation. Regarding the comment about the potential environmental concerns outlined in the 2016 Terracon report, we are proposing the following actions in order to address it. Fill Dirt Pile #8 appears to be located on the southern portion of the subject property. C&H conducted a topographic survey in April of 2021 and did not locate any evidence of dumped soil/gravel piles on the subject property. Attached is a copy of the topographic survey for reference. So it appears that this dirt pile was previously removed. It’s unknown whether any remnants of this pile remain on site and would only be discovered upon future excavation. The report outlines that Fill Dirt Pile #8 contained hydrocarbons (at levels below MDEQ screening levels) and various RCRA metals (at levels below MDEW RBSLs). No volatile organic compounds (VOCs) were present. It should be noted that Fill Dirt Pile #8 mainly consisted of topsoil. No regulatory notification actions or remediation was required. This in only mentioned to highlight that Fill Dirt Pile #8 does not appear to present any serious risk. Given the fact that the dirt pile was removed and that the contaminates were relatively minor, our proposal is to include a note on the civil plans which says: “Contractor to notify engineer immediately upon uncovering any soils determined to be contaminated or comprised of non-native fill material. Any soils determined to be contaminated or comprised of non-native fill material shall be removed from the site, properly characterized and treated/and or disposed in accordance with applicable local, state, or federal regulations.” This seems like a fair approach given the background. In my opinion, it doesn’t seem reasonable to conduct a full scale Phase 2 Environmental Site Assessment at this time. Thanks for taking the time to review this and let us know what your thoughts are.
