RE: ANE 9TEN MIXED-USE COMMENT RESPONSES - CIVIL
TD&H ENGINEERING JOB NO. B21-055
The following responses are being provided to the Engineering Comments dated January
4, 2022 for the 9Ten Mixed-use Site Plan Application R01 (21351):
ENGINEERING ADVISORY COMMENTS:
The following comments must be addressed with future applications
1. DSSP Plans and Specification Review Policy – Plans, specifications, and submittals for
public infrastructure improvements (sewer mains, storm mains in the ROW, streets, alleys,
and street lighting) must be submitted to the City Engineering Department
(engsubmittals@bozeman.net) for infrastructure review.
RESPONSE: Understood – the public infrastructure plans have been submitted and we
are working through the coordinated sewer plan revisions.
2. DSSP V.D.1 - The alignment of all water, sanitary sewer, and storm sewer mains and
services lines shall be arranged so that there is a minimum of ten (10) feet of horizontal
separation between these lines and with any gas lines, power lines, communication lines,
utility poles or other above- grade utility structures, and street lights.
a. The applicant is encouraged to work with the City to achieve proper utility
separation. To facilitate a solution the applicant must clearly identify utilities
proposed to remain, be relocated, or be removed. The applicant shall work with the
City and utility providers to limit separation conflicts. At no time shall new utilities
conflict with this standard. The applicant must provide an agreeable solution for
utility reconstruction and long term maintenance prior to infrastructure approval
RESPONSE: An agreeable solution has been coordinated and we are revising the
infrastructure plans accordingly.
3. DSSP Fire Service Line Standard – Plans for all fire service lines must be submitted to the
City Engineering Department (engsubmittals@bozeman.net) for review.
RESPONSE: Understood – the fire service line plans will be submitted in conjunction
with building permit application.
4. BMC 38.270.030.C.1 - To achieve building permit approvals prior to completion of (identified
improvements for the project) the applicant must follow BMC 38.270.030.C.1 options b and
c. The applicant shall provide a completed concurrent construction form found here
https://www.bozeman.net/home/showpublisheddocument/11704/637738829990130000. All
items on this form must be provided prior to building permit approval.
RESPONSE: Understood – We will complete and provide the items identified with the
CCON form prior to building permit approval.

5. North 7th Avenue is Montana Department of Transportation (MDT) right of way. The
applicant must coordinate with MDT during the construction of West Aspen Street
Connection to North 7th.
RESPONSE: Understood – we are preparing an encroachment permit to complete the
W. Aspen Street connection to N. 7th Avenue as coordinated with MDT.
