SEWER AND WATER PIPELINE AND ACCESS EASEMENT AND AGREEMENT
FallonFirst,LLC,a Montanalimitedliabilitycompany,witha mailingaddressofPO Box
161236,PO Box 161236,BigSkyMT 59716,GRANTOR,inconsiderationof$1.00andfor
otherandvaluableconsideration,receiptofwhichisherebyacknowledged,grantstoTheCityof
Bozeman,a MunicipalCorporationoftheStateofMontana,withofficesat121NorthRouse
Avenue,P.O.Box 1230,Bozeman,Montana59771-1230,GRANTEE,itssuccessorsand
assigns,a perpetualeasementtolay,constructandmaintainsanitaryseweranddomesticwater
pipelineswiththeusualservices,valves,manholes,connections,accessoriesandappurtenances
forthepurposeoftransmittingwaterandsanitarysewerin,throughandacrossastripofland
situatedinGallatinCounty,Montana,30feetwidetobelocatedonthefollowingdescribedreal
property:
Lot IA,Block14,NORTON EAST RANCH SUBDIVISION,PHASE 4,[PlatJ-669-A],
CityofBozeman,accordingtotheplatthereof,onfileandofrecordintheofficeoftheClerk
and Recorder,GallatinCounty,Montana,and locatedin theSouthI/2of Section9,
Township2 South,Range5 EastofP.M.M..
TheeasementismoreparticularlyshownanddimensionedontheattachedExhibitA,whichby
thisreferenceismadeapartofthisdocument.
ThisgrantincludestherightoftheGRANTEE,itssuccessors,permittees,licensees,andassigns
anditsandtheiragentsandemployees,toenteratalltimesupontheabove-describedlandby
usingexistingroadsortrailsorotherwisebyaroutecausingtheleastdamageandinconvenience
totheGRANTOR(S)inordertosurveyandestablishtherouteandlocationoftheeasementand
thepipelineandto:
(1)Construct,operate,patrol,repair,substitute,remove,enlarge,replace,andmaintainthe
pipelines,manholes,services,connections,accessoriesandappurtenances;
(2)Trim,remove,destroy,orotherwisecontrolanytreesandbrushinsideoroutsidethe
boundariesoftheeasementwhichmay,intheopinionoftheGRANTEE,interfereor
threatentointerferewithorbehazardoustotheconstruction,operationandmaintenance
ofthepipelines;
(3)Gradethelandsubjecttothiseasementandextendthecutsandfillsofthisgradinginto
andonthelandadjacenttothatwhichissubjecttothiseasementtotheextentGRANTEE
may findreasonablynecessary;and
(4)SupportthepipelineacrossravinesandwatercourseswithstructureswhichGRANTEE
deemsnecessary.
THE GRANTEE AGREES:
(1)That,inconnectionwiththeconstruction,operating,patrolling,repairing,substituting,
removing,enlarging,replacing,and maintainingof saidwaterand sanitarysewer
pipelines,itwillrepairorreplace,atitssoleexpense,orpay toGRANTOR(S)the
reasonablevalueofanydamagestogrowingcrops,existingfences,ditchesandother
appurtenancesofsaidlandthatmay bedisturbedbyitsoperation.
(2)That,duringoperationsinvolvingexcavation,itwillremovethetopsoilfromthetrenched
areatoa depthofonefoot,ortothefulldepthofthetopsoil,whicheverisless,and
stockpilesaidtopsoilforreplacementoverthetrench.Itwillremovefromthesiteany
largerocksorsurplusexcavatingmaterialoranydebristhatmay havebeenexposedby
theexcavationandremainsafterbackfillingiscompleted.And,itwillleavethefinished
surfaceinsubstantiallythesameconditionasexistedpriortothebeginningofoperations
exceptthatthesurfaceofbackfilledareasmay bemoundedsufficientlytopreventthe
formationofdepressionsafterfinalsettlementhastakenplace.
THE GRANTOR(S)AGREES:
(1)Atnotimewilltheybuild,construct,erectormaintainanypermanentstructurewithinthe
boundariesofsaideasementwithoutthepriorwrittenconsentofGRANTEE.
(2)Atnotimewilltheymodifythefinishedgradeofthelandoverthepipelinesbyremoval
ofexistingsoilorbyplacementoffillmaterialwithintheboundariesofsaideasement
withoutthepriorwrittenconsentoftheGRANTEE.
(3)Thatwherethesubjectimprovementsarenotlocatedunderimprovedpublicorprivate
streetsor otherprovidedaccess,a 12 footwideall-weatheraccessroadmay be
constructedwithintheeasementwhereattheCity'sdiscretionsuchaccessisrequiredfor
operationandmaintenancepurposes.
(4)The GRANTOR(S)warrantsthattheyarelawfullyseizedandpossessedofthereal
propertydescribedabove,thattheyhavea lawfulrighttoconveyaneasementon the
property,oranypartofit,andthattheywillforeverdefendthetitletothisproperty
againsttheclaimsofallpersons.
(5)TheGRANTEE may peaceablyholdandenjoytherightsandprivilegeshereingranted
withoutanyinterruptionbytheGRANTOR(S).Theterms,covenantsandprovisionsof
thiseasementandagreementshallextendtoandbebindingupontheheirs,executors,
administrators,personalrepresentatives,successorsandassignsofthepartieshereto.
