HomeMy WebLinkAbout21- Waiver of Right to Protest Creation of Special District or SID - Bronken WarehouseInter-officeOriginalto: CityofBozeman Box 1230 ª Bozeman MT 59771-1230 WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL DISTRICT OR SPECIAL IMPROVEMENT DISTRICTS BRONKEN WAREHOUSE (#21274) The undersigned owner of the realpropertysituatedin the County of Gallatin,Stateof Montana,and more particularlydescribedas follows: Lots 5 &6 of Block 3 of Nelson Meadows Subdivision,SituatedintheSE ¼of Section22 and NE ¼of Section27,Township 1 South,Range 5 East,PMM,Cityof Bozeman,Gallatin County,Montana IN CONSIDERATION of receivingapproval forsiteplan of the subjectpropertyfrom the City of Bozeman,along with accompanying rightsand privilegesand forotherand valuableconsideration, the receiptof which ishereby acknowledged,and in recognitionof the impacts to PrinceLane,Royal Wolf Way,Nelson Road,Frontage Road which willbe caused by the development ofthe above- describedproperty,theowner has waived and does hereby waive foritself,itssuccessorsand assigns foreverthe rightto protestthe creationof one or more specialdistrictsor specialimprovement districtsforthedesign and engineering,constructionand maintenance of followingimprovements: a.Streetimprovements to PrinceLane between Nelson Road and Frontage Road including lighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. b.Streetimprovements to Royal Wolf Way between Nelson Road and northernright-of-way establishedwith theNelson Meadows Subdivisionplatincludinglighting,signalization, paving,curb/gutter,sidewalk,and storm drainage. c.Streetimprovements to Nelson Road includinglighting,signalization,paving,curb/gutter, sidewalk,and storm drainage. d.Streetimprovements to Frontage Road between Nelson Road and East Valley Center Spur/PrinceLane includinglighting,signalization,paving,curb/gutter,sidewalk,and storm drainage. e.Intersectionimprovements atPrinceLane and Nelson Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. f.Intersectionimprovements atPrince Lane and Royal Wolf Way includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. g.Intersectionimprovements atPrince Lane and Frontage Road Avenue includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. h.Intersectionimprovements atRoyal Wolf Way and Nelson Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. i.Intersectionimprovements to Nelson Road and Frontage Road includinglighting, signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. j.Intersectionimprovements to East Valley Center Spur and Frontage Road including lighting,signalization/channelization,paving,curb/gutter,sidewalk,and storm drainage. Landowner agreesthe City has the solerightto controlthedesign and constructionof such improvements and may includeany oftheabove components and othersnecessarytoensure such improvements comply with alladopted City infrastructureplansand requirements.Further,the Landowner waives itsrightor to make any writtenprotestagainstthe sizeor areaor creationof the 2 districtbe assessedinresponse to a duly passed resolutionof intentionto createone or more special improvement districtswhich would includetheabove-describedproperty. In the event a specialdistrictor specialimprovement districtisnot utilizedforthe completion ofthese improvements,the developeragreestoparticipateinan alternatefinancingmethod forthe completion of saidimprovements on a fairshare,proportionatebasisas determined by the City on the basisof the square footageofproperty,taxablevaluationoftheproperty,trafficcontributionfrom the development or a combination thereof. This waiver ismade forthebenefitof thepropertydescribedhereinshallbe a covenant running with the land.
