The above describedtractof land isto be known and designatedas AllisonSubdivision Phase 4,City ofBozeman,GallatinCounty,Montana;and thelands includedinallstreets, avenues,alleysand parks or publicsquaresshown on saidplatarehereby grantedand donated to the City of Bozeman forthepublicuse and enjoyment.Unless specificallylistedherein,the landsincludedin allstreets,avenues,alleys,and parks or publicsquaresdedicatedto thepublic are accepted forpublicuse,butthe City acceptsno responsibilityformaintainingthesame.The owners agreethattheCity has no obligationto maintain the landsincludedinallstreets,avenues, alleysand parks or publicsquared hereby dedicatedtopublicuse.The lands includedinall streets,avenues,alleysand parks or publicsquaresdedicatedto the publicforwhich the city acceptsresponsibilityformaintenance includedWest Graf Street. 1 IN CONSIDERATION of receivingapproval forsubdivisionof the subjectpropertyfrom the City of Bozeman,along with accompanying rightsand privilegesand forotherand valuable consideration,thereceiptof which ishereby acknowledged,inrecognitionof the impacts that willbe generatedby the development oftheabove-describedpropertyatAllisonSubdivision Phase IV,have waived and do hereby forourselves,our heirs,personalrepresentatives, successorsand assigns,the rightto protestthe creationof one or more specialimprovement districtsforthe constructionof: a.Street improvements to South 11th Avenue including paving,curb/gutter, sidewalk,and storm drainage; b.Streetimprovements to West Graf Streetincludingpaving,curb/gutter,sidewalk, and storm drainage; c.Streetimprovements to South 7thAvenue includingpaving,curb/gutter,sidewalk, and storm drainage; d.Intersectionimprovements to South 11thAvenue and West Graf St; e.Intersectionimprovements to South lithAvenue and Kagy Boulevard; f.Intersectionimprovements to South 7thAvenue and Kagy Boulevard Landowner agrees the City has the sole rightto controlthe design and constructionof such improvements and may include any of the above components and others necessary to ensure such improvements comply with alladopted City infrastructureplans and requirements. Further,theLandowner waives itsrightor to make any writtenprotestagainstthe sizeor areaor creationof the districtbe assessedin response to a duly passed resolutionof intentionto create one or more specialimprovement districtswhich would includethe above-describedproperty. In the event a specialdistrictor specialimprovement districtis not utilizedfor the completion of these improvements,the developer agrees to participatein an alternatefinancing method for the completion of said improvements on a fair share,proportionatebasis as determined by the City on the basis of the square footage of property,taxablevaluationof the property,trafficcontributionfrom the development or a combination thereof. 2 This waiver shallbe a covenant running with the land and shallnot expire with the dissolutionof the limitedpartnership,provided however thiswaiver shallapply to the lands hereindescribed.
