Dear Commissioners,
I am writing regarding the Zone Map Amendment No 21356. The proposal to rezone the parcel of
land along North Third Avenue between West Lamme and West Beall streets from R-4 to B-3 will
have a significant impact on the Northeast neighborhood. To maintain the character of the
neighborhood requires careful planning in transition zones like this.
I live at 320 North Grand directly behind the proposed Ives Building and participated in the zoning
change of the Medical Arts parking lot parcel that was changed from R-4 to B-3 in 2019. It was
noted during the September 16, 2019, City Commission meeting when the Commission accepted the
change that the commission would carefully deliberate the transition between development on the
property and its suitability with neighboring properties. This was stated clearly by then
Commissioner Kraus at about 2:28:51.
“Certainly height is a consideration in B3 and how would that look right next to this [parking lot
being rezoned]? But I would also say, of course, that we put in transition zones between B3 and
residential zones.”
Yet, the Commission has accepted a plan that allows a 70 foot building, the maximum height
allowed by code, to be built across the alley from single family residential homes. ZMA 21356
proposes a similar zoning change that also sits adjacent to residential homes. I find this change
problematic because the Commission has not defined a reasonable transition between R-4 and B-3
that maintains the character of the historic neighborhoods.
The current R-4 zoning allows for development that promotes a range of housing types as defined by
Goal N-1 of the Bozman community plan. Housing that would be compatible with the adjacent
neighborhoods and that would not tower over existing structures. The Bozeman Strategic Plan asks
for a “safe, healthy, welcoming, and inclusive community.” Living below or walking by a 6 story
building as allowed under B-3 zoning is not welcoming nor does it promote a feeling of safety.
Furthermore, it shades the neighboring houses, reducing sunlight and solar potential.
We are all aware that Bozeman is growing and I am not opposed to that growth. Our community can
flourish with growth that honors the long-standing character of Bozeman that has thrived on nature,
individualism, quaint culture, and assertive outdoor activity. Thoughtful transition between
commercial and residential building must be considered to maintain that character.
