NOTICE OF A PUBLIC HEARING FOR AN APPEAL OF AN
ADMINISTRATIVE PROJECT DECISION
This application is evaluated against the Administrative Project Decision Appeals criteria of section
38.250.030 of the municipal code and associated standards.
Project Name: North Central Master Site Plan and North Central Block 4 Site Plan Appeal
Appeal number: 22005
Summary: An appeal of two Administrative Project Decisions for the North Central Master Site
Plan (MSP), application 21029, and North Central Block 4 (the Ives) Site Plan, application 21165, has
been submitted alleging that the City of Bozeman’s (City) approval of the MSP should be overturned
because the MSP: does not meet the intent and purpose of the Neighborhood Conservation Overlay
District (NCOD); has a mass, scale, and transition contrary to the Bozeman Community Plan 2020
and other Bozeman codes; does not comply with the NCOD; and received approval for an
inappropriate parking plan. The appeal also alleges that the public received inadequate notice due to
a discrepancy in the number of parking spaces noted on the Master Site Plan application and on its
public notice.
The appeal also alleges that the City’s approval of the Ives should be overturned because the City
inappropriately approved an engineering modification to standards regarding placement of a
driveway access from West Villard Street and inappropriately approved acceptance of an equivalent
amount of money instead of requiring dedicated parkland.

The City Commission, acting as a board of adjustment pursuant to Resolution 1440,
will hold a public hearing on both appeals and issue a decision on each at its meeting
on Tuesday, March 8, 2022, which will be held via WebEx or in person at 6:00 p.m.
The public may comment orally at the public hearing or in writing at or prior to the public hearing
regarding compliance of this application with the required criteria. Comments should identify the specific
criteria of concern along with facts in support of the comment.
