Call to Order – Nolan called the meeting to order at 4:34pm. B. Disclosers – none. C. Changes to agenda – none. D. Public comment – none. E. Approval of Minutes Nolan motioned approval of June 3 minutes as presented; Emily seconded the motion. All in favor. F. Action Item – Update on the Westlake Park Planning Effort (see Attachment A) Addi Jadin w/Parks gave update. SWMBIA moving dirt this season so everyone is seeing that activity. Site plan was submitted and should be reviewed next week. Addi noted hoping to go to bid in early spring, describing design now includes all sections previously shared with MURB. She highlighted how this newer site plan ties together the variety of sections of the park. Board discussion opened, including questions as to maintenance. Addi said that is within the new park district and should, in theory, be covered by the parks department. David called for public comment. The only person dialed into the meeting was city staffer Brit Fontenot with no questions or comments. G. 1. FYI/Discussion Short Street Reconstruction Update David shared update. Two different engineering plans were at play, curb mistakenly removed creating a water problem. As required problem fix within the commission-approved project budget, David recapped emailing the board on June 30 (see Attachment B) as to the necessary fix and the current opportunity to take advantage of employed crew to make the fix without delay. Board discussion included concern for rushed process but also thanks to staff for making it happen within the same construction season. David noted agenda complete and asked for any questions from the board. Nolan requested update on board consolidation plan. David noted MURB in Phase II of process with a forecasted timing of within yr2022. Discussion followed. David asked the board if they still wanted to do a walking tour of the District and yes was the response. He will seek a date for this activity. H. Adjournment Adjourned at 5:04pm. 8 Page 2 of 2 Attachment A 9 Memorandum REPORT TO:Midtown Urban Renewal Board FROM:David Fine, Economic Development Program Manager SUBJECT:Recommendation Regarding the Aspen Festival Street Lighting and a Related Budget Amendment and Change Order MEETING DATE:February 3, 2022 AGENDA ITEM TYPE:Citizen Advisory Board/Commission RECOMMENDATION:I move to recommend that the Bozeman City Commission amend the budget for the Midtown Urban Renewal District to include up to $133,225 for modifying the street light poles on the Aspen Festival Street to facilitate the reinstallation of string lights in compliance with the National Electrical Code (NEC) and the City Code and to recommend a change order with Knife River to complete the work. STRATEGIC PLAN:2.2 Infrastructure Investments: Strategically invest in infrastructure as a mechanism to encourage economic development. BACKGROUND:The string lights on the Aspen Festival Street were found to be in breach of the National Electrical Code (NEC) during an electrical inspection by the Bozeman Building Division. At their low point, the lights hung at 16 feet, while the code required a minimum of 18 feet. In addition, staff were notified by the Community Development Department that the lights, as installed, were in violation of the City "night skies" code. While the lights selected are capable of being outfitted with compliant shields, the original design did not call for installation of the shields. After much deliberation about how to approach the issue, staff determined that the string lights needed to be removed until a solution could be implemented to raise the lights to a height that complies with the NEC and City Code. The lights were removed and stored for future installation in early December. The City's engineering consultants with Sanderson Stewart worked with the contractor, Knife River, on designing and pricing fixes to allow the lights to be reinstalled. The two proposed solutions are raising the light bases or purchasing taller light poles. Sanderson Stewart received pricing from Knife River showing that purchasing new light poles was the cheaper option at a cost of $133,375. Lead time on procuring new poles is 20-22 weeks. 10 Staff is seeking a recommendation from the Board to the City Commission on the best way to proceed. UNRESOLVED ISSUES:Staff is working on options to recover some of the costs related to this item from the relevant parties. These efforts have not concluded. Given the nearly six month lead time for new light poles, Staff recommends moving forward to ensure that new light poles are ordered in a timely manner. ALTERNATIVES:As suggested by the Board. FISCAL EFFECTS:The cost of ordering and installing new light poles "Option 2" is $133,375. This option would require the adoption of a budget amendment to allow adequate budget authority to move forward.
