Reference: Application No. 21021, Revision #2 - First Security Bank Site Plan
Dear Mikaela:
In response to your memorandum dated June 28, 2021, we have revised the application documents. Responses to comments are provided below.
1. The applicant must address all the master site plan comments and receive master
site plan approval prior to site plan approval. The site plan must be consistent with the master site plan.
Response: The master site plan has been resubmitted to address prior comments. The site
plan and master site plan have been updated to provide consistent references to the easements that will be executed with the amended plat.
2. Applicant must submit above noted easement drafts [mutual access, drainage, utility] using the City standard easement template attached to this transmittal for
review to the review engineer. Upon review and approval of the draft the applicant must deliver a hard copy of this easement to review engineer for processing and
filing with the city clerk.
Response: All easement documents have been updated to the City templates and submitted to the review engineer for review. The final easement documents are provided with this
application, as well as with the revised SE application. Signed easements will be recorded with the amended plat.
3. BMC 38.410.130: Water rights and/or payment of cash-in-lieu of water right is required
prior to development for the demand on the City’s potable water system. The applicant must contact Griffin Nielsen with the City Engineering Department to obtain a determination of
cash-in-lieu of water rights (CILWR).

Response: The information regarding cash-in-lieu of water rights has been emailed to
Griffin Nielsen. We are still waiting on response to the information so that the correct
amount can be paid.
4. If not already filed, the applicant must provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special
Improvement Districts.
Response: The Waiver of Right to Protest Creation of Special Improvement Districts has
been filed the County Clerk and Recorders Office. A copy has been provided.
