DRAINAGE EASEMENT
GLACIER BANK, a Montana banking corporation, 49 Commons Loop, Kalispell MT
59901, GRANTOR, in consideration of $1.00 and for other valuable consideration, receipt of
which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of
Montana, with offices at 121 North Rouse Avenue, Bozeman, Montana 59715, GRANTEE, its
successors and assigns, a perpetual non-exclusive easement for the use of the GRANTEE, in,
through and across a strip of land situated in Gallatin County, Montana, to be located on the
following described real property:
Lots 13A, 14A & 15A of the Amended Plat of Lots 13, 14, & 15, Block 1 of Phase 1 of the
Gallatin Center Subdivision P.U.D., Phase 4, according to the official plat thereof on file in
the office of the Clerk and Recorder of Gallatin County, Montana, under Document No.
________________ ;
This easement is more particularly shown and described on said plat as “DRAINAGE
EASEMENT”.
The GRANTOR warrants that it is lawfully seized and possessed of the real property
described above, that it has lawful right to convey the property, or any part of it, and that it will
forever defend the title of the property against the claims of all persons. The GRANTOR further
agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted
without any interruption by the GRANTOR.
The terms, covenants and provisions of the easement and agreement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors and assigns of
the parties hereto.
