I would like the Commission to delay the Canyon Gate proposal. This is a great project - perhaps in 15 to 20
years when the land that is already within the City limits has been developed and this project could be
better justified. If the developers are keen on constructing such a project, a temporary delay could allow
the developers to submit to the City an alternative site within the City limits. The same amount of dollars
would flow into the community, but I am sure that such a study would show that an alternative site would
be less costly for needs public-supported infrastructure, i.e., road construction, sewer and water needs, etc.
The current situation assumes that our region is still land-rich - it isn’t, particularly sensitive and open lands
that are enjoyed by the public. Also, it takes no account of the carbon footprint that this project would have
as opposed to one within our fine City, less environmental damage overall, less congestion, as well as the
lower infrastructure costs mentioned above. Your job is to provide sound, sensible growth for Bozeman -
everyone wants this and so do I, so keep your eye on the ball - ensure the public welfare is served and
minimize potential harm (unnecessary infrastructure costs associated with this project as well as all the
unnecessary costs associated with sprawl at this time). We all can prosper with sensible guidelines and you
are tasked with this job - start being sensible and talk straight to developers who are acting rationally, but
not with the general public’s interests in mind. A clear planning guide for them would be beneficial for all. It
is my understanding that the Supreme Court has ruled in many such cases (particularly those involving a
taking request that: NO ONE HAS AN ABSOLUTE RIGHT TO USE HIS PROPERTY IN A MANNER THAT MAY
HARM THE PUBLIC HEALTH OR WELFARE, OR DAMAGE THE INTERESTS OF NEIGHBORING LANDOWNERS OR
THE COMMUNITY AS A WHOLE. (Takings Law in Plain English, Duerksen and Roddewig, American Resources
Information Network, 1994, page 23}. I believe that the law, the public good, and sound, sensible
