Your December 3, 2021 public comment letter stated that you provided “a self-addressed envelope for correspondence including city comments to this letter” (emphasis added). That is why the provided envelope was used to inform you that “Community Development does not directly comment on or reply to public comments received” and why the December 3, 2021 email response to you included “as requested in your letter, I have also sent this response using the self-addressed stamped envelope provided.” Your letter did not mention the final decision or request a copy of it. Also, upon receipt of my letter you were aware that the City was no longer in possession of an envelope with which to mail you a copy of the decision. As with all administrative decisions, notice of this administrative decision was disclosed and available to the public through the Community Development map tool on our website. Dear Ross, It was brought to my attention this week by other non-official means, a decision may have been made on Application 21029 also known as the North Central Master Site Plan. I was NOT notified in writing of this decision as requested. Per code 38.230.090E.1.a(1), BMC, I provided a self addressed envelope for the explicit use to provide a decision notice sent back to me. At this time, it’s of my opinion, the City of Bozeman is NOT in compliance with noticing requirements and that I have not been given adequate disclosure and opportunity to review the planning departments decision. This has not allowed me the opportunity within the 10 days of post decision to make a determination of whether I would like to mount an appeal based on my public comments submitted. I am requesting a reset of the 10 days to review and decide if I want to appeal the decision by the City of Bozeman. This can be sent via mail as originally requested or email at this time.
