Commissioners,
Please review carefully the applicant’s language in the recent Annexation Agreement that
would limit the maximum height of structures located within the proposed R-5 zoning district
to a maximum of 50 feet or 4 stories, whichever is greater. The annexation agreement
included with the packet contains these two provisions.
It does not appear that there is anything to limit the height of a story, therefore 4 stories could
be greater than 50 feet. As per Table 38.320.030.C for building heights with a greater than or
equal to 3:12 pitch a height of 60 ft plus 12 feet exceedance would still be possible in R-5.
