To whom it may concern:
I'm writing to address the appeal of the issuance of business license 21-69197. My wife and I live on Spring Creek Drive withour 9 month old son and frequently walk him in his stroller around Spring Creek Drive and Highland Court.
In written communication, the city has stated that it "understands that not every house orneighborhood will be a good fit for a day care facility" and references Montana Department of Health and Human Servicesregulations for group day care facilities [1]. None of the state regulations listed mention any consideration of a facility'slocation within a neighborhood. The day care facility at 2107 Highland Court in Bozeman is situated at the apex of a downhillcorner on a north-facing slope. Owing to the northerly aspect, this area of the street tends to get icy early in the winter andstays that way until long after nearby streets have melted out. The city does not appear to have given adequate considerationto the very real safety hazard at this location when paired with a business involving small children being picked up anddropped off throughout the day.
As residents of this neighborhood, my family and I have had to rapidly move out of the way of cars arriving at or departingfrom 2107 Highland Court whose drivers are not aware of pedestrians in the area and some of which, particularly during thewinter months, did not appear to be fully in control of their vehicles. I fear that it is only a matter of time before an accidenthappens as a result of the high volume of traffic in this otherwise quiet residential area.
The City of Bozeman needs to recognize that 2107 Highland Court is not a suitable location for a day care facility andaccordingly, The City Commission should overturn the City’s decision to issue business license 21-69197 and invalidateAdministrative Rule 2021-01 as both were improperly issued.
