We are opposed to this development for many reasons & specifically for those noted in theattached letter. We look forward to hearing from you & ideally seeing significant

Dear Planner Garber,
I am writing comment in regard to application 21029 North Central Master Site Plan. I do not believe
this application should be approved at this time for the following reasons:
We have discussed this matter with our neighbors & all have similar concerns.
Notice Inconsistency
The summary in the notification is inconsistent with the back page (2nd page). It is not clear how many
units will be built: front page 493 dwelling units, the back page 367 dwellings. There are 646 proposed
parking spots on the front and 541 parking spots on the back page. I do not see how conformance to
code can be determined when facts and data do not match. I would ask for a reissuance of noticing to all
affected people and delay in decision.
Traffic Study
The original traffic study, 1st and 2nd updates don’t reflect the actual correct number of proposed
residential units (I count 396 in the study, while the notice summary proposes 493). This is a 24%
difference which may direct impact on the ability of the local streets to support the traffic load. I would
ask for an updated study that reflects the proposed units to ensure traffic impacts are mitigated to the
surrounding area and adjustments to the site plan requirements reflect corrected numbers.
Master Site Plan Mixed Use Type Not Identified
The code under section 38.310.* has identified mixed use types such an urban mixed use (38.310.050)
and residential emphasis mixed-use zoning (38.310.060). The notification nor the website I am directed
(in the notification) has sufficient documentation posted to show what type of mixed use plan or
whether it is in conformance. Depending on the mixed use, this proposed master site plan may not be in
conformance of required mixed use densities (e.g. residential vs. commercial).
The only information I see, is a table of contents page:

refers to land use, zoning, and intensity with no backup documentation. I am of the opinion this is
inadequate public disclosure and therefore the application cannot be approved until this information is
publicly available via the communication mechanism identified in the notice, with adequate comment
period.
Nonconformance with Section 38.430.010
Section 38.430.010 identifies development intent. Subsections 12 and 13 as stated:
12. To protect existing neighborhoods from the harmful encroachment of incompatible developments;
13. To promote logical development patterns of residential, commercial, office and industrial uses that
will mutually benefit the developer, the neighborhood and the community as a whole;
This development with a proposed 1 million+ proposed square feet, hasn’t shown that it’s mass in scale
will protect and enhance existing bordering R-2 and R-3 neighborhoods. The number of buildings, the
height of buildings and overall development footprint will cause harmful encroachment onto the
boarding neighborhoods including the North Tracy Historical area. This is an incompatible development
to the surrounding area.
In review of the documentation, I only see a very generalized community benefit pie diagram
(https://weblink.bozeman.net/WebLink/DocView.aspx?id=256412&dbid=0&repo=BOZEMAN which
provides no detail of how this development is not harmful to the surrounding R-2 and R-3
neighborhoods. It also doesn’t demonstrate how it will be compatible.
I do not see per subsection 13 how this development promotes beneficial development to the
surrounding neighborhood, where the neighborhood will benefit from this development.
