Olive Street Bozeman, MT 59718 RE: Narrative Response to Comments – Bridger Vale PUD Subdivision Final PUD Comments Dear Mr. Krueger: This letter is to provide a narrative response to the planning and engineering comments provided on January 25, 2021 and January 25, 2021 respectively: Planning Division, Brian Krueger, bkrueger@bozeman.net, (406) 582-2259 1. Condition of approval 5. The City provided Bridger Vale Notice of Planned Unit Development Restrictions must be recorded with the final plat. • This item is noted, the notice of Planned Unit Development Restrictions will be recorded with the final plat. 2. Condition of approval 8. The required notice must be recorded with the final plat. • An Affordable Housing Plan is included with the resubmittal package. Comments from Affordable Housing provided on October 16, 2020 have been addressed in a separate narrative. 3. Code provision 7. BMC 38.430.040.A.3. The PUD final plan cannot be approved at this time as the park plan is not in conformance to PUD preliminary plans approved by the City Commission. The trail connection proposed to the existing trails within the East Gallatin Recreation Area is now proposed by others. This was not proposed in the preliminary landscape plans and the connection must be provided from this development to the existing trail system. Sheet L2.4 still states the trail connection will be made by others. This is not consistent with the park plan approved for this development. • This item is noted. The updated landscaping plans have been provided and no longer shows the trail connections as “by others”. The trail connection has been financially guaranteed. Civil/Structural Engineering and Surveying 4. General comment. The nonconforming lighting on the Commercial Lot 1 must be removed. It was not shown on PUD plans. • This item is noted. The nonconforming light on Commercial Lot 1 will be removed prior to the filing of the final plat. Engineering Division, Lance Lehigh, Engineering III 1. Code provision 4. BMC 38.220.300 and 310 and BMC 38.410.080.D. The POA documents include a stormwater maintenance plan, but do not specifically reference the requirements to maintain stormwater facilities and their locations. The POA documents do not reference collecting assessments to provide maintenance for stormwater facilities. On page 13 of the POA documents add references for stormwater maintenance requirements. a. The applicant did not provide a formal comment or update the POA documents. • The stormwater facilities are defined in Article II under Common Areas and Facilities. Article V, Section 2 states that the Association shall be responsible for the maintenance, repair and replacement of Common Areas and Facilities, including the stormwater facilities. The stormwater facility maintenance is referenced on Page 13, Article IX, Section 19. Article XII, Section 1 explicitly includes the stormwater facility maintenance in part of the levying assessments on lots. The stormwater facilities maintenance plan has been updated to include the construction plans for stormwater facilities that indicates the location of the facilities. 2. Code provision 6. BMC 38.410.080. The applicant did not provide the stormwater report in the submittal. The engineer of record needs to provide justification/confirm that groundwater will not impact the function or maintenance of the facilities. A geotechnical analysis was not provided or seasonal high groundwater information. a. No response from applicant. • The approved stormwater report is included in the resubmittal. This stormwater report and infrastructure plans were approved by the City of Bozeman prior to construction. Ground water monitoring on the property has also been provided in section 15.
