MACK, WATER RESOURCES SPECIALIST III DATE: APRIL 9, 1991 In the past, city crews would enter icy Bozeman (Sourdough) Creek wearing chest waders and carrying an axe. It would take six workers all day to chop the ice out of the creek to keep it flowing in its channel. Today the channel is kept open by pumping 50 degree Fahrenheit water into the creek. This system is used only as needed. Since use varies year to year depending on the weather, actual volume is difficult to determine. A volume figure is not needed and instead should allow as much water as is needed, based on permitted flow rate. This 20" well was drilled in 1936 and is 303 feet deep. City Hall was built over this well. It was cut down and is currently located in the basement of the Police Station. At approximately 150' , the casing is reduced to 16" . Three different pumps are placed in this well. The 5 hp pump is set at 54 feet and puts out 250 gpm. Two one-horse pumps each pump 50 gpm. The total withdrawal is 350 gpm. The permit is for only 300 gpm. I informed John McNeil, City Parks Superintendent, that the additional 50 gpm should be filed on. Mr. McNeil told me that when the pumps are replaced, a larger capacity pump will be installed. The use is ice control. Municipal use lends a connotation of human use, within the municipality, it is not that. It would not be considered commercial since water is not used incidentally in the exchange or buying and selling of a commodity. Of our use codes, industrial seems to fit best. Industrial is water used to produce a commodity. A commodity is any useful thing, that which constitutes an end. Warm water used to melt ice is a useful thing. Dear Per;nittee: This letter is your Final Reminder that your Provisional Permit, or granted Extention of Time, requires you to file a "Notice of Completion of Permitted bVater Development", Form No. 617 on or before 11/30/87. NOTE: Completion of your permit means that your diversion, impoundment or withdrawal facility is completed, and that the flow rate and volume of water has actually been applied to beneficial use in substantial accordance with the granted permit. Recent legislation requires all Applications for Extension of Time to be public noticed with an opportunity for objections to be filed. A $25.00 filing fee must accomr.-eny each application. With these changes to the process, you are encouraged to complete your project by the due date referenced above. If your project is now complete, please file a Form No. 617. If you will be unable to complete your project by the required deadline, you must file an Application for Extension of Time, Form No. 607, prior to that date. Should we not receive Form No. 617, or Form tm. 607, on or before the completion due date, the Department may modify or revoke your permit, as provided in Section 85-2-314, MCA. The Department will send you a certified notice if it has decided to modify or revoke your permit. At that time you will have the opportunity to request a hearing to show cause why your permit should not be modified or revoked. If you will not be completing your appropriation in substantial accordance with Your Provisional Permit and filing Form No. 617, or filing an Application to Extension of Time, please sign and date the attached acknowledgment and return it to this field office as soon as possible. In the past a Permittee simply requested an extension of time, we reviewed the application to be sure it was justified and reasonable, and usually we granted an extension of time in which to complete the project. Now, all Applications for Extension of Time must be published once in the local newspaper. In addition, the individuals who were initially notified of your proposed project will also be informed of your request for more time to complete the project. There is also a required $25.00 filing fee on the Application for Extension of Time (Form No. 607) . A copy of Form No. 607 is enclosed for your convenience. Your permit, as noted above, requires that the project be completed by 11/30/87.
