RE: 21169 – UPS Bozeman Distribution Facility Site Plan Review – Response to Comments
Below are responses to City comments received on 5/17/2021 as part of the Site Plan Review Application
Submitted on 4/21/2021.
Section 4 – Required Code Corrections
PLANNING COMMENTS:
1. Submittal – BMC 38.230.100. Provide a CILWR estimate from Griffin Nielsen, gnielsen@bozeman.net.
CILWR must be paid prior to final site plan approval.
CT Response: Griffin Nielsen was contacted regarding the status of his review of the CILWR. No
feedback has been received to date.
2. Block Frontage Standards – BMC 38.51.030.G Façade transparency. Show how the south and east
elevation are meeting this requirement. Staffs calculations are showing this standard is not being
met. Please provide a calculation box next to each building elevation showing the square footage of
the façade and the percent glazing/transparency for each.
CT Response: A calculation box has been added to Sheet A202 that shows the total area of the
building façade is 8,571 square feet and that 877.5 square feet of glazing are provided on the South
Elevation #3. City of Bozeman staff clarified, via email dated May 26, 2021, that the East façade
doesn’t generally face the street and isn’t required to have 10% of the façade glazed.
3. Building Materials – BMC 38.530.060.C.2. Metal siding. Provide details addressing how the metal
thickness and features will meet this provision.
CT Response: Metal siding is specified to meet the minimum 24-gauge requirement, and all flashing
trim and molding will be hemmed at exposed edges. Flashing details have been added to this
resubmittal on Sheets A315 and A316.
4. Blank wall treatments – BMC 38.530.070. A blank wall is present on the east and west elevations (see
below). This needs to be addressed with a proposed treatment.

CT Response: A variety of wall treatments have been used on the building facades to break the
building form into more human scaled segments. On all sides of the building, we have utilized color
variations to bring the tall façade down to a more human scale, along with weather canopies to help
break up the taller sections of wall.
Additionally, on the east façade to address the ‘blank wall’ issue, the metal paneling has been divided
into smaller sections and the orientations of the panels have been rotated in a checkboard type
pattern to add visual interest. The variety of panel orientations breaks up the façade into a more
approachable human scale and further addresses the blank wall issue.
Per email dated 6/9/21, City of Bozeman staff clarified the blank wall treatment is not required on the
west façade due to the distance from the right-of-way.
5. Mandatory landscaping provisions – BMC 38.550.050.B. Drought tolerant species required. Show how
this provision is being calculated. Staffs calculations identified approximately 65% of the species as
drought tolerant based on the species and quantity list provided, not the required 75%.
CT Response: Two species have been switched to approved drought tolerant species. Calculations as
follows:
494 drought tolerant plants ÷ 575 total plants (trees, shrubs, and perennials) = 85% drought tolerant
plants.
6. Mandatory landscaping provisions – BMC 38.550.050.C.2.b. The required number of parking lot trees
appear to have been provided (nine trees total). Eight are provided via large canopy trees, and one is
a large non-canopy tree. The non-canopy tree requires a small tree in addition to meet this
provision.

CT Response: Evergreen tree has been switched to a large canopy tree.
7. Mandatory landscaping provisions. – BMC 38.550.050.C.2.e.2. Proposal has one section of parking
stalls that exceeds the 100 feet maximum. This section needs to be modified to meet this standard.
CT Response: Length of row has been adjusted to meet the 100-foot minimum. Island layout and
parking lot landscaping has been adjusted accordingly.
8. Mandatory landscaping provisions - BMC 38.550.050.E.1. Street frontage landscaping required.
Adjust the proposed street trees to meet this standard, or provide explanation as to why they are not
provided at this cadence. In addition, ensure street trees are not conflicting with stormwater, wet or
dry utilities.
CT Response: After discussion about visibility for UPS trucks at driveways, 10-foot utility clearance,
and sidewalk clearance for street trees in a virtual meeting, Lynn Hyde emailed the following
instruction:
“As we discussed, all along Royal Wolf Way, the street trees are going to be pushed towards
the site, or to the west, due to distance requirements from the water main. This adjustment
will be pushing them within 2 feet of the sidewalk. In general we would like at least 3’ from
the sidewalk for the street trees. In certain instances (high visibility areas) we are willing to go
less if site constraints make it necessary, however in this area we do not think going less than
2’ is appropriate. If you are not able to get greater spacing for the trees, you can remove
them. Creativity is appreciated to figure out how to place the trees so if your arborist has an
idea, please suggest it. Along Prince Lane there is more opportunity to be creative due to the
easement no longer being present on the inside of the sidewalk, so please work to place the
trees whether between the sidewalk and road where the space exists, or on the inside of the
sidewalk towards your property.”

The following constraints along Royal Wolf Way prevented the placement of 7 of the 8 required
street trees: a) the proposed public sidewalk is placed 1 foot from the property line per City standard,
and b) the placement of existing water main. All but one of the required street trees was able to fit in
the boulevard while maintaining the 2-foot sidewalk clearance and 10-foot utility clearance, and
dimensions of 2.15 and 10.21 are noted on L501. The width of the mature tree trunk was also
considered when deciding if a tree could fit within the margin between the 2-foot sidewalk clearance
and 10-foot utility clearance. The ability for a landscape installer to place a tree with exact plan
dimensions is also unlikely, where at least a 6 to 8-inch margin of error is expected on any given
project. Dimensions of 11.97 and 12.05 are noted on both ends of the boulevard on L501. Street
trees we not placed on the west side of the sidewalk on private property due to a series of
easements, totaling at approximately 62.23 feet.
Along Prince Lane, the required quantity of street trees we able to be placed, but were not able to
meet spacing requirements due to the required 10-foot clearance from the existing water main,
causing some of the street trees to be placed on private property along the ROW. Where the existing
water main makes an approximately 45-degree turn in the alignment of Prince Lane, 3 street trees
spaced at approximately 40-41 feet apart were able to meet the 10-foot clearance requirement and
be centered in the boulevard. The rest of the required street trees were placed on the inside of the
property, just outside the 20-foot easement. Trees were placed 10 feet from the easement
considering that future utilities could be installed in the easement and that the 10-foot clearance
requirements would apply.
9. Mandatory landscaping provisions - BMC 38.550.050.G.3.a.2. The evergreen tree proposed shows a
minimum planting height of 5’. Adjust landscaping plans to meet the requirement of 8’ minimum
planting height.
CT Response: Evergreen tree has been switched to a large canopy tree.
10. Lighting – BMC 38.570
a. Provide specifications (cut sheets) for your lighting fixtures that show how you are meeting
this provision.
CT Response: Cut sheets provided.
b. Provide a legend on the photometric plan that shows which symbol are the building lights
and which are the pole lights.
CT Response: See attached site lighting plan (Sheet ES101) from building package.
c. Add a note on the Sheet stating that the lighting fixtures, locations, and operations
(including hours of operation) will comply with the provisions outline in the Bozeman
Municipal Code (BMC), in particular provisions outlined in BMC 38.570.
CT Response: Site lighting will comply per the BMC 38.570 and operate only during operating night
time hours and will utilize dimmed motion activated lighting from (11pm-4am).
d. BMC 38.570.040.G.3 – Except for residential lighting, street lighting, pathway intersection
lighting and security lighting, all lighting must be turned off between 11:00pm and 6:00 am.
Exceptions will be granted to those businesses which operate during these hours; such
lighting may remain illuminated only while the establishment is actually open for business.
What are the hours of operations? Seasonally, will this facility operate 24.7? Note, this does
not apply to motion activated lighting.

CT Response: Site lighting will comply per the BMC 38.570 and operate only during operating night
time hours and will utilize dimmed motion activated lighting from (11pm-4am).
e. The photometric plan is difficult to read the foot candles in areas due to overlapping
numbers. Ensure that the customer parking and entrance is adequately lit as well as parking
areas for employees.
CT Response: Parking and paved entrances shall be adequately lit for safety and security per 10th
Edition of IESNA.
SOLID WASTE
1. Must have 50 foot of straight approach to front of refuse enclosure
CT Response: 50’ distance is provided. A dimension showing this space has been added to plan sheet
C100 and C101
2. Need a detailed plan for refuse enclosure showing all dimensions.
CT Response: Detail 1 on Sheet A315 is a detailed plan showing all dimensions for the refuse
enclosure.
BUILDING
1. After March 22,2021 the energy Code is to be 2018 IECC as adopted by the City and State.
CT Response: The portions of the building envelope required to comply with the IECC have been
designed in accordance with the 2018 version of the IECC. The majority of the building (warehouse
area) does not contain conditioned space, per the IECC definition of conditioned space, and therefore the
building envelope in those areas is not required to comply with the IECC. However, the Office areas are
fully conditioned, and therefore the building envelope in those areas has been designed in accordance
with the 2018 IECC.
2. Ensure fence plans are provided on the building plan submittals
CT Response: Fence plans will be provided with the building plan submittal.
NORTHWESTERN ENERGY
1. The transformer does not need to be placed within an enclosure. NWE prefers to not install the
transformer in an enclosure.
CT Response: The transformer enclosure has been removed.
2. Gas and electric services can be installed within the same trench.
CT Response: The proposed gas line has been adjusted to be in the same trench as electric.
3. A 10-ft utility easement will need to be created where the electric primary originates from the edge
of the existing utility easement near the electric junction can up to the transformer location.
CT Response: A new 10’ utility easement has been shown on the civil plans.
4. If using a screen wall and the meter is a self-contained meter base the minimum distance in front of
the meter is 48 inches.
CT Response: Clearance exceeding 48 inches is provided in front of the meter, refer to enlarged plan on
sheet A702.

ENGINEERING COMMENTS:
GENERAL:
1. If not already filed for the subject site, the applicant must provide and file with the County Clerk and
Recorder's office executed Waivers of Right to Protest Creation of Special Improvement
Districts (SID’s).
a. The applicant must use the language from the standard City template for the waiver. The
template is attached for the applicant’s reference.
CT Response: The waiver right to protest SID document has been updated to match the language in
the template provided. This document has been signed and notarized and a digital copy is provided
for review in this resubmittal. The original signed copy can be provided at final site plan
2. The applicant has submitted a subdivision exemption for the aggregation of lots. The subdivision
exemption must be approved and recorded prior to site plan approval.
CT Response: Acknowledged. The subdivision exemption has been reviewed and approved by the city,
county, and state. Mylars of the amended plat are currently being awaiting signature from the
community development director and will be recorded upon completion.
3. Per the plat, the easement along the northern property line is twenty feet wide. The applicant must
revise the easement location on the plans and adjust the site design accordingly.
CT Response: The north utility easement shown has been adjusted to 20’ wide. Further adjustments
have been made to avoid improvements within this easement including shifting the proposed fencing
and north drive aisle. Proposed landscaping will remain within the easement.
TRANSPORTATION
1. BMC 38.230.100.A.6.a Plan Review Criteria - An estimate for the developments peak-
hour trips as well as the assumed peak-hour trips from the subdivisions traffic impact study must be
provided with a future site plan. If the development will substantially exceed the original assumed
trip estimate the assumptions and conclusions presented in the traffic impact study must be
reviewed to determine if any additional mitigation is required. The review must be performed by a
professional engineer registered in the state of Montana.
a. The trip generation estimate submitted by the applicant uses the Industrial Park land use
trip generation rate. Due to the wide range of land uses covered by this land use type, the ap
plicant must provide a comparison of the Industrial Park land use trip generation rate and th
e proposed development’s specific trip generation rate.
CT Response: The traffic memo has been updated to include UPS specific estimated traffic data for this
proposed facility in addition to the Industrial Park land use calculations.
WATER
1. DSSP.V.A: Prior to a determination of adequacy the applicant must provide an estimate of the
average and max day demands of domestic water usage for the proposed development. The
estimates must be certified by a professional engineer.
a. The applicant must indicate the references used for the calculation assumptions.
CT Response: The water memo has been updated to include reference to Montana DEQ for domestic
water usage as well as a direct comparison to the existing facility in Bozeman.

2. DSSP V.D.6- Trees or other significant landscaping features shall not be placed within ten (10) feet
of any utility main or service lines.
a. The street trees along Royal Wolf Way and Prince Lane are proposed to be within ten feet
of the water main. The applicant must move the trees away from the main.
CT Response: Upon further discussion with the planning department, it was agreed to place the
street trees along Royal Wolf Way only where the separation requirements from the public utilities
and sidewalk can be met. The street trees along Prince Lane are adjusted accordingly as well with
placing several trees behind the utility easement where they are unable to be placed within the ROW.
3. The applicant must provide a detail for the transition of the four-inch ductile iron service pipe to the
two-inch copper service pipe.
CT Response: A detail for this water line transition has been added to plan sheet C403.
WATER AND WASTEWATER
1. BMC 38.410.070. Municipal Water, Sanitary Sewer and Storm Sewer – The proposed project is located
within the service area of the Nelson Meadows Lift Station. The proposed project may not exceed
the lift station capacity reserved for the subject property without an upgrade to the existing lift
station and associated force main. The applicant must demonstrate the design capacity reserved for
the parcel relative using the subdivisions wastewater design report to the proposed peak-
hour wastewater flow from the proposed project.
a. The applicant must indicate the references used for the calculation assumptions.
CT Response: The wastewater memo has been updated to include reference to Montana DEQ for
domestic wastewater flows as well as a direct comparison to the existing facility in Bozeman.
2. The applicant must use the City of Bozeman’s Deep Sanitary Sewer Service Standard Drawing No.
02730-3 for sanitary sewer services deeper than six and a half feet. The applicant must include a note
on the plan sheets and the detail on the detail sheets.
CT Response: The proposed sanitary sewer service will be connecting to an existing service stubbed
into the property. Therefore, Standard Drawing No. 02730-3 will not apply. It was verified by
Morrison-Maierle that this detail was utilized when the sewer service was originally installed as part
of the subdivision infrastructure.
WATER RIGHTS
1. BMC 38.410.130 (A) (1) Water rights - The applicant must contact Griffin Nielsen with the City
Engineering Department to obtain a determination of cash-in-lieu of water rights (CILWR).
CILWR must be paid prior to site plan approval.
a. The cash-in-lieu of water rights memorandum was received and forwarded to Griffin Nielsen
for determination
CT Response: A determination has not yet been received by Griffin.
ADVISORY COMMENTS
1. There is a “No Build” restriction on the lot which will remain until a connection is made between
the Nelson Meadows lift station to the City’s water reclamation facility (WRF). As such a building permit
will not be approved until the restriction is released by the City.
CT Response: Acknowledged.

2. The applicant must prepare plans and specifications for any fire service line in accordance with the city’s
Fire Service Line Policy. The plans must be prepared by a Professional Engineer and be provided to and
approved by the City Engineer prior to initiation of construction of the fire service or fire protection syst
em. The applicant must also provide Professional Engineering services for construction inspection, post
construction certification and preparation of mylar record drawings. Fire service plans, and domestic ser
vices 4” or larger, must be a standalone submittal, separate from the site plan submittal. City of Bozema
n applications for service must be completed by the applicant.
CT Response: Acknowledged.
Water Conservation DRC Comments Chelsey Trevino – ctrevino@bozeman.net Water Conservation
Technician
1. It is recommended that all grass areas to be installed as sod be clearly indicated within the landscape
design and plant legend.
CT Response: Acknowledged. There is no sod on the project, only seeded areas to achieve dryland grass.
2. Topsoil depth specification of 4”- 6” (after grading) to allow for proper root depth growth and assist
with plant and turf grass resiliency is recommended.
CT Response: Acknowledged.
3. Please specify the proper installation and adjustment of overhead irrigation rotors and sprays to
minimize overthrow onto the pavement.
CT Response: Acknowledged.
4. It is recommended that water efficient sprinkler nozzles (multi-spray, multi-trajectory nozzles or ‘rotary
nozzles’) be installed if overhead irrigation is to be used within turf grass lawn areas.
CT Response: Acknowledged.
