RELEASE AND RECONVEYANCE OF EASEMENTS
COMES NOW, the City of Bozeman, 121 N. Rouse Ave, P.O. Box 1230, Bozeman, MT
59771-1230, a Municipal Corporation of the State of Montana, hereinafter referred to as
("GRANTOR"), and does hereby release and reconvey the following described easements unto
Village Investment Group, Inc., a Montana Corporation as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of utility easements situated across Lot
4A,Minor Subdivision 344C,City of Bozeman, Gallatin County,Montana. The easement is more
particularly shown and dimensioned on the attached Exhibit A, which by this reference is made a
part of this document.
WHEREAS the above utility easements were granted by Stephen E. Sande and Mabel H.
Sande, and Norman C. Sande and Carole A. Sande by the following instruments:
Book 20 of Misc.,Pages 425-428,recorded on November 28,1962 at the Clerk and Recorder's
Office of Gallatin County, Montana.
WHEREAS no public utilities are located within the easements to be released and the
vacation of the said easements will not adversely impact the Grantor's or the Public Utility
Company's interests.
WHEREFORE, the Grantor does hereby release and reconvey to the Village Investment
Group, Inc., those portions of the utility easements located on the above described real property as
set forth on Exhibit A,attached hereto,together with any right,title,or interest that the Grantor may
have in said utility easements as set forth on said Exhibit A,attached hereto and incorporated herein
by reference as though fully set forth and shown on Exhibit A.
This reconveyance shall not affect the remainder of those easements shown on said Book 20
of Misc., pages 425-428, files of the Clerk and Recorder's office of Gallatin County,Montana.
