Hi all, It looks like these changes to the ordinance will provide more defined protection forneighborhoods within earshot of construction in all zoning designations. I will be sending acomment to the commission requesting we use both a dB (A) and dB (C) weighted filters. While dB (A) measures audible noise, it does not capture low level frequencies such as bass orvibrations that are typically "felt instead of heard". These measurements would be capturedusing the dB(C) filter. The only potentially problematic element I can see is on the enforcement side of thingswhereby only two individuals are trained to use measurement equipment. One would hope, however, that Marty doesn't get burnt out responding to 8:01pm calls for noise ordinanceenforcement. Cheers, Emily Virus-free. www.avg.com On Wed, Sep 22, 2021 at 11:21 AM Dani Hess <dhess@bozeman.net> wrote: Hello Neighbors, see below from Community Development Director, Marty Madsen. Thanks!Dani Dear Neighbors, As requested by the City Manager and City Commission, staff drafted changes to theCity’s “Noise Ordinance” and will present these changes to the City Commission onOctober 26, 2021 for its consideration. I am writing you today to let you know aboutthese proposed changes in advance and to offer you a chance to provide input. City Code currently limits construction activities in most residential zone districts tothe hours of 6:00am to 10:00pm and uses a “reasonable person” standard to measurethe noise level. In general terms the proposed ordinance would implement a decibelstandard and limit construction activities that exceed 60 decibels to daytime hours, between 7:00am and 8:00pm. The actual language is below. “Noise emanating from a construction operation occurring between thehours of 8:00 PM to 7:00 AM is prohibited from exceeding 60dB(A) asmeasured at the property line of an immediately adjacent property.” I have attached the proposed ordinance in .pdf format so that you can see the draftchanges. Please be aware that this a draft version and that the language is stillsubject to changes. The underlined verbiage is the proposed new text and the strike-out text is current City Code that would no longer be applicable. Input suggesting changes to the proposed ordinance should be sent directly to me prior to October 1st at: mmatsen@bozeman.net. I appreciate your feedback even though I cannotguarantee that your suggested changes will be included in the proposed ordinance. Staff is planning to present this revised ordinance to the City Commission for discussion and a vote on Tuesday, October 26th. As always you may send publiccomment expressing general support or displeasure to City Commissioners atagenda@bozeman.net. Keep in mind that all comments will be available for publicview. Thank you for your time and consideration. Best Regards – Marty MARTY MATSEN, AICPDirector | Community Development | City of Bozeman 20 East Olive St. | P.O.
