GRANT OF EASEMENT FOR DRAINFIELD
COMES NOW, GERALD D. ROBERTSON and MARILYN M. ROBERTSON of
3120 Wagon Wheel Road, Bozeman, Montana 59715 and hereby grant
an easement for a drainfield on the following described real
property owned by them in Gallatin County, Montana, to-wit:
Tract B of Certificate of Survey No. 526, a tract of
land located in the SW-� of Section 19, Township 2
South, Range 6 East, P.M.M_, Gallatin County, Montana,
according to the official plat thereof on file and of
record in the office of the County Clerk and Recorder
of Gallatin County, Montana.
Said Grant of Easement for Drainfield shall be for the
benefit of the owners of the following described real property in
Gallatin County, Montana to-wit:
units 1, 2, 3 and 4 of Kent Hal Condominium, situated
on Tract A of Certificate of Survey No. 526, located in
the SW; of Section 19, Township 2 South, Range 6 East,
M_P.M. , Gallatin County, Montana, according to the
official plat thereof on file and of record in the
office of the County Clerk and Recorder of Gallatin
County, Montana. Together with a 25t undivided
interest for each unit in the common elements of the
condominiums appertaining to such units, the
Declaration for which was recorded May 16, 1978 in Film
43, page 1355, records of Gallatin County, Montana.
The use of the condominium units shall be for
residential purposes only.
This Grant of Easement shall be as shown and depicted on
attached Exhibit "A" for use as a drainfield only. This grant of
easement shall be perpetual, shall run with the land, and shall
bind the heirs, successors and assigns of the parties hereto.
However, in the event the above property is connected to city
sewer services, this easement shall terminate and be of no
further force and effect.
