RE: Bozeman CoHousing Departure Narrative: BMC Table 38.320.030
Dear Susana:
On behalf of our client, we are requesting a departure from BMC Table 38.320.030 regarding
maximum lot size of residential developments for the Bozeman CoHousing development. The
subject property is located at 3120 Wagonwheel Rd. Please see below for a departure narrative
and rationale as to why the departure is necessary.
Departure Narrative:
Table 38.320.030.A of the Unified Development Code (UDC) states that the maximum lot area
in an R-3 zoned district is 2.5 acres. After a lot line aggregation is approved, the subject
property will total 5.297 acres, which exceeds the maximum lot area.
Departure Rationale:
Note 5 under Table 38.320.030.A states: “Departures from the maximum lot size requirements
may be allowed where the planned development fits into the context of the neighborhood and
proposed pedestrian and vehicular circulation measures meet community objectives”.
The proposed lot area of 5.297 acres encompasses the 43-unit CoHousing development. The
current configuration of the site has been designed to encourage pedestrian and bicycle use.
Pedestrian and vehicular circulation meet community objectives by providing a logical flow
throughout the development.
Splitting lot lines within the development to satisfy the code would create unnecessary
boundaries throughout the site. Additionally, building configurations would need to be
redesigned around these lot lines, which would create an undesirable flow for pedestrian
pathways throughout the site. Keeping the 5.297-acre tract intact will help to maintain the
integrity of pedestrian flow along with the overall layout of the site. Please see the attached site
plan for the current pedestrian and vehicular circulation through the site as well as the proposed
building configurations.
