NOTICE OF FINAL OCCUPANCY RESTRICTION AND BUILDING PERMIT
RESTRICTIONS FOR SOUTH UNIVERSITY DISTRICT PHASE 3 MAJOR
SUBDIVISION
NOTICE IS HEREBY GIVEN to all current owner(s) and potential purchasers of land within the
South University District Phase 3 Major Subdivision,which is described herein,that the final plat
of the subdivision was approved by the Bozeman City Commission before all required
improvements were completed, as is allowed in the Bozeman Municipal Code. As such, an
Improvements Agreement was filed with the final plat that stipulates the time period during which
the improvements must be completed,and those improvements were guaranteed by occupancy and
building permits restrictions to the City of Bozeman by the Subdivider, RTR Holdings II, LLC.
THEREFORE,BE ADVISED,that occupancy permits will not be issued for any restricted blocks
1-4 or any restricted lots on those blocks within the subdivision (see Sheet 2 of 3 of South
University District Phase 3 Major Subdivision Plat) until all public and private infrastructure,
buildings, and landscaping for the individual restricted blocks 1-4 or any restricted lots on those
blocks are completed and accepted by the City of Bozeman as identified with the Phasing Plan for
Concomitant Construction. No partial occupancy within a restricted blocks 1-4 or any restricted
lots on those blocks is permitted.
These improvements include, but are not limited to water, sewer, stormwater systems, street,
parking, sidewalk, lighting improvements within rights-of-way and open space, parkland, and
landscaping.
AND BE ADVISED that building permits for each restricted blocks 1-4 or any restricted lots on
those blocks will not be issued until all public and private infrastructure for the lot/block are
completed and accepted by the City of Bozeman or an alternative Improvements Agreement is
authorized by the City.
South University District Major Subdivision is legally described as:
South University District Phase 3 Major Subdivision, a tract of land located in the
southwest quarter(SWl/4) of Section 13 and the northwest quarter(NWl/4) of Section
24,Township 2 South,Range 5 East,Principal Meridian Montana upon Lot 2 of South
University District Ph. 2 Minor Subdivision(PLAT J-605), City Of Bozeman, Gallatin
County,Montana, containing 74.87 acres,more or less.
