WARRANTY DEED

For Value Received, RTR Holdings II, LLC,for Three River Capital, LLC, its manager,
a Montana limited liability company with address of 22 Turtle Rock Court, Tiburon CA
94920, the Grantor, does hereby grant, bargain, sell, convey and confirm unto the City of
Bozeman, a Montana municipal corporation with address of 121 North Rouse Ave.,
Bozeman, Montana 59715, the Grantee, the following described premises in Gallatin
County, Montana,to-wit:
City Park 3 being 13.36 acres more or less as depicted and described on
the final plat of the Amended Plat of Lot 2, South University District Phase
2 (Plat J-605) being located in South University District Phase 3, in the SW'i4
of Section 13 and the NE1i4 of Section 24, Township 2 South, Range 5 East,
City of Bozeman Gallatin County, Montana (Plat No. J-605) J-695
And
City Park 4 being 1.83 acres more or less as depicted and described on the
final plat of the Amended Plat of Lot 2, South University District Phase 2
(Plat J-605) being located in South University District Phase 3, in the SW1i4
of Section 13 and the NE1i4 of Section 24, Township 2 South, Range 5 East,
City of Bozeman Gallatin County, Montana (Plat No. J-605) J-695
SUBJECT TO easements, conditions, restrictions and rights-of-way shown or
indicated in the public records or plats filed and recorded in the office of the County Clerk
and Recorder of Gallatin County, Montana, or which may be ascertained from a visual
inspection of the land, including ditch and utility easements. Subject to prior mineral,
oil and gas, and patent rights and reservations and exceptions, if any; Subject to taxes
and other governmental charges and assessments accruing or imposed after the date
hereof; Subject to building and use restrictions and zoning ordinances, if any.
TOGETHER WITH all tenements, hereditaments and appurtenances thereto, and
all reservations and remainders, and all rents, issues and profits thereof, and all right,title
and interest of the Grantor therein.
TO HAVE AND TO HOLD the said premises, with its appurtenances unto the said
Grantee, its heirs and assigns forever, and the said Grantor does hereby covenant to and
with the said Grantee that Grantor is the owner in fee simple of said premises; that it is
free from all incumbrances, and that Grantor will warrant and defend the same from all
lawful claims whatsoever.
