RESOLUTION 5331
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS
TRACTS OF LAND,HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF
THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE
CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACTS,KNOWN AS
THE UNIVERSITY CROSSING APARTMENTS 2021 ANNEXATION,APPLICATION
21152.
WHEREAS,theCityofBozeman receivedapetitionforannexationfrom StevenR Aaker
requestingthe CityCommission to extendtheboundariesof theCityof Bozeman so as to include
an areaoflandcontainingapproximately10,247squarefeet,locatedat2025 W.Kagy Blvd;and
WHEREAS,an annexation staff report was prepared in accordance with the
Commission's goalsand policiesforannexationand was presentedtotheCommission on August 3,
2021;and
WHEREAS,a publicmeeting on saidannexationpetitionwas dulynoticedand held on
August 3,2021;and
WHEREAS,theCitydidnotreceiveany writtenprotestfrom therealpropertyowners of
theareatobe annexed;and
WHEREAS,on September 14,2021,theCommission receivedtheexecutedannexation
agreement addressingallrecommended termsofannexation;and
WHEREAS,the provisionof availableservices,including,but not limitedto,streets,

rights-of-way,easements,waterrightsor cash-in-lieu,waiversof protestagainstcreationof SID's,
and water and sewer hookup fees,to saidcontiguoustractsas describedisthe subjectof a written
agreementbetween theCityand theLandowner;and
WHEREAS,the Bozeman City Commission hereby findsthatthe annexationof this
contiguoustractisinthebestinterestsoftheCityofBozeman and theinhabitants/ownersthereof.
NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of
Bozeman,Montana,towit:

That itisherebydeclaredthat,pursuanttoTitle7,Chapter2,Part46,Mont.Codes Ann.,the
following-describedproperty,which iscontiguousto the municipal boundaries of the City of
Bozeman,be annexed totheCityofBozeman and thattheboundariesofsaidCityshallbe extended
so astoembrace and includesuch approximately10,247sq.ft.,towit:
That partofLot 2A,Minor SubdivisionNo.191-B,accordingtotheplatthereof,on file
and of recordintheofficeoftheClerk and Recorder,GallatinCounty,Montana,and
locatedinthe SoutheastQuarterofSection14,Township 2 South,Range 5 Eastof
P.M.M.,GallatinCounty,Montana,describedasfollows:
