RESOLUTION 5324
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,PROVIDING FOR THE ANNEXATION OF CERTAIN CONTIGUOUS
TRACTS OF LAND,HEREINAFTER DESCRIBED,TO THE CORPORATE LIMITS OF
THE CITY OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE
CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACTS,KNOWN AS
THE 2021 NE DAVIS LANE AND WESTLAKE ROAD ANNEXATION,APPLICATION
21186.
WHEREAS,the City of Bozeman receiveda petitionfor annexationfrom Cascade
Development,LLC requestingtheCityCommission toextendtheboundariesoftheCityofBozeman
so as to includean area of land containingapproximately17.197 acres,locatednortheastof the
cornerofDavis Lane and Westlake Road;and
WHEREAS,ownershipofthelandhas changed and Bozeman Development,LLC arethe
currentlandownersofrecordofrealpropertydescribedasAllthatpartofthe S ½NW ¼ofSection
26,Township 1 South,Range 5 East,PrincipalMeridian,GallatinCounty,Montana,lying
south and west ofthe south rightofway ofHighway as statedinbargain and saledeeds book
145,page 19 and film143,page 646,requestingtheCityCommission to extendtheboundaries
of theCityofBozeman;and
WHEREAS,an annexation staff report was prepared in accordance with the
Commission's goalsand policiesforannexationand was presentedtotheCommission on September
14,2021;and

WHEREAS,a publicmeeting on saidannexationpetitionwas duly noticedand heldon
September 14,2021;and
WHEREAS,theCitydidnotreceiveany writtenprotestfrom therealpropertyowners of
theareatobe annexed;and
WHEREAS,on September 14,2021,theCommission receivedtheexecutedannexation
agreement addressingallrecommended terms of annexation;and
WHEREAS,the provisionof availableservices,including,but not limitedto,streets,
rights-of-way,easements,waterrightsor cash-in-lieu,waiversof protestagainstcreationof SID's,
and water and sewer hookup fees,to saidcontiguoustractsas describedisthe subjectof a written
agreementbetween theCityand theLandowner;and
WHEREAS,the Bozeman City Commission hereby findsthatthe annexationof this
contiguoustractisinthebestinterestsoftheCityofBozeman and theinhabitants/ownersthereof.
NOW,THEREFORE,BE IT RESOLVED by the City Commission of the City of
Bozeman,Montana,that:

That itisherebydeclaredthat,pursuanttoTitle7,Chapter2,Part46,Mont.Codes Ann.,the
following-describedproperty,which is contiguousto the municipal boundaries of the City of
Bozeman,be annexed totheCityofBozeman and thattheboundariesofsaidCityshallbe extended
so astoembrace and includesuch approximately17.197acres,towit:
