PUBLIC ACCESS EASEMENT
Bozeman Development,LLC GRANTOR(S),in considerationof one dollar($1.00)and for
otherand valuableconsideration,receiptof which ishereby acknowledged,grantsto the City of
Bozeman,a Municipal Corporation of the Stateof Montana,with officesat 121 North Rouse
Avenue,Bozeman,Montana 59715,GRANTEE,a publicaccess easement fora multi-usepath
forthe use of thepublicin,through and acrossa 25 feetwide stripof land situatedin Gallatin
County,Montana,which islocatedon the following describedproperty:All thatpartof the
South Half of theNorthwest Quarter (S1/2NW1/4)of Section26,Township 1 South,Range 5
East,M.P.M.,lyingSouth and West of the South right-of-waylineof the highway right-of-way
heretoforedeeded tothe Stateof Montana by deed dated December 19,1963,and recorded
February 14,1964,inBook 145 of Deed Records of GallatinCounty,Montana,atPage 19.
Excepting thatportionto the Stateof Montana by Bargain and Sale Deed recorded April 18,
1994 in Film 143,Page 646,recordsof GallatinCounty,Montana.
The easement ismore particularlydescribedon the attachedExhibitA which by this
referenceare made a parthereof.
The GRANTOR(S)agrees:
(1)To constructand maintain themulti-usepath attheirown expense in accordance with
relevantCity Ordinances,including,but not limitedto,snow removal and allmajor and
minor repairwork.
(2)To allow the City to make any and allinspectionsof the multi-usepath and land
appurtenanttheretoas the Cityreasonably deems necessary.
The GRANTOR(S)warrant thatthey are lawfullyseizedand possessed of the real
propertydescribedabove,thatthey have a lawfulrighttoconvey theproperty,or any partof it,
and thatthey willforeverdefend thetitleto thispropertyagainstthe claims of allpersons.
The GRANTOR furtheragreesthatthe GRANTEE may peaceably hold and enjoy the
rightsand privilegeshereingrantedwithout any interruptionby the GRANTORS.The terms,
covenants and provisionsofthiseasement shallextend toand be binding upon the heirs,
executors,administrators,personalrepresentatives,successorsand assignsof thepartieshereto.
