Pathway Design Departure Request
Dear Mr. Matsen,
This letter is to request a departure from the pathway design requirements in standard 38.520.040.D for the Gallatin
Park Mixed Use submittal. Ms. Garber mentioned the possibility for a departure in her comments from the first round
of DRC Review.
38.520.040.D – Pathway Design: Pathways must be separated from structures by at least three feet of landscaping
except where the adjacent building façade meets the Storefront block frontage standards per section 38.510.030.B.
Departures are permitted for other landscaping and/or façade treatments to provide attractive pathways will be
considered. Examples include sculptural, mosaic, bas-relief artwork, or other decorative treatments that meet the
intent. The requested departure is to allow concrete in front of the rollup garage doors to allow vehicle access inside of
the commercial units. The units are designed to allow parking inside or temporary access for loading, etc. Requiring
landscaping between the pathway which is 3’ away from the building and the garage door would eliminate access to
these doors. The design provides adequate separation and screening on the street facing building, but the internal
pathways do not provide a 3’ pathway separation along the entirety of the building as a result of the garage doors. The
concrete connection between the pathway and the garage doors is necessary for access, same as at each man door.
The intent of this section is to provide separation between the pathway and the building to provide attractive pathways
to improve the experience for the user. The pathway is still separated from the building by the required three feet, the
area in front of the doors is now filled with concrete. The concrete will be jointed as shown on sheet C-2 to delineate
the 5’ pathway even in front of the garage doors. The garage doors are not typical garage doors, but are upgraded full
glass garage doors. The upgraded doors will not detract from the visually appealing façade like standard garage doors
would, but actually add streetside appeal and transparency. The front of the buildings meets several requirements of
the storefront standards and end up being a mesh between the two standards.

As can be seen in Figure 1, some areas of the building are setback from the pathway by 5’ instead of the minimum 3’.
These wider areas have additional vegetation planned to offset the areas in front of the garage doors.
We request that you consider our departure to allow this project to be able to provide this specific product which is
sought after by businesses in many industries. We feel that the upgraded garage doors, the visually appealing façade,
the areas of wider separation, and the increased landscaping offset the areas which require concrete access instead of
landscaping.
